55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the release of a motor vehicle accident report to a
88 first lienholder of a vehicle damaged in the accident described by
99 the report.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 550.065(c), Transportation Code, is
1212 amended to read as follows:
1313 (c) On written request and payment of any required fee, the
1414 department or the governmental entity shall release the information
1515 to:
1616 (1) an entity described by Subsection (b);
1717 (2) the law enforcement agency that employs the peace
1818 officer who investigated the accident and sent the information to
1919 the department, including an agent of the law enforcement agency
2020 authorized by contract to obtain the information;
2121 (3) the court in which a case involving a person
2222 involved in the accident is pending if the report is subpoenaed; or
2323 (4) any person directly concerned in the accident or
2424 having a proper interest therein, including:
2525 (A) any person involved in the accident;
2626 (B) the authorized representative of any person
2727 involved in the accident;
2828 (C) a driver involved in the accident;
2929 (D) an employer, parent, or legal guardian of a
3030 driver involved in the accident;
3131 (E) the owner of a vehicle or property damaged in
3232 the accident;
3333 (F) a person who has established financial
3434 responsibility for a vehicle involved in the accident in a manner
3535 described by Section 601.051, including a policyholder of a motor
3636 vehicle liability insurance policy covering the vehicle;
3737 (G) an insurance company that issued an insurance
3838 policy covering a vehicle involved in the accident;
3939 (H) an insurance company that issued a policy
4040 covering any person involved in the accident;
4141 (I) a person under contract to provide claims or
4242 underwriting information to a person described by Paragraph (F),
4343 (G), or (H);
4444 (J) a radio or television station that holds a
4545 license issued by the Federal Communications Commission;
4646 (K) a newspaper that is:
4747 (i) a free newspaper of general circulation
4848 or qualified under Section 2051.044, Government Code, to publish
4949 legal notices;
5050 (ii) published at least once a week; and
5151 (iii) available and of interest to the
5252 general public in connection with the dissemination of news; [or]
5353 (L) any person who may sue because of death
5454 resulting from the accident; or
5555 (M) the first lienholder of a vehicle damaged in
5656 the accident, including:
5757 (i) a vehicle storage facility that is
5858 licensed under Chapter 2303, Occupations Code, and is the first
5959 lienholder of the vehicle; and
6060 (ii) a towing company that is licensed
6161 under Chapter 2308, Occupations Code, and is the first lienholder
6262 of the vehicle.
6363 SECTION 2. This Act takes effect September 1, 2017.
