| 7 | 7 | | relating to the release of a motor vehicle accident report to a |
|---|
| 8 | 8 | | first lienholder of a vehicle damaged in the accident described by |
|---|
| 9 | 9 | | the report. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 550.065(c), Transportation Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (c) On written request and payment of any required fee, the |
|---|
| 14 | 14 | | department or the governmental entity shall release the information |
|---|
| 15 | 15 | | to: |
|---|
| 16 | 16 | | (1) an entity described by Subsection (b); |
|---|
| 17 | 17 | | (2) the law enforcement agency that employs the peace |
|---|
| 18 | 18 | | officer who investigated the accident and sent the information to |
|---|
| 19 | 19 | | the department, including an agent of the law enforcement agency |
|---|
| 20 | 20 | | authorized by contract to obtain the information; |
|---|
| 21 | 21 | | (3) the court in which a case involving a person |
|---|
| 22 | 22 | | involved in the accident is pending if the report is subpoenaed; or |
|---|
| 23 | 23 | | (4) any person directly concerned in the accident or |
|---|
| 24 | 24 | | having a proper interest therein, including: |
|---|
| 25 | 25 | | (A) any person involved in the accident; |
|---|
| 26 | 26 | | (B) the authorized representative of any person |
|---|
| 27 | 27 | | involved in the accident; |
|---|
| 28 | 28 | | (C) a driver involved in the accident; |
|---|
| 29 | 29 | | (D) an employer, parent, or legal guardian of a |
|---|
| 30 | 30 | | driver involved in the accident; |
|---|
| 31 | 31 | | (E) the owner of a vehicle or property damaged in |
|---|
| 32 | 32 | | the accident; |
|---|
| 33 | 33 | | (F) a person who has established financial |
|---|
| 34 | 34 | | responsibility for a vehicle involved in the accident in a manner |
|---|
| 35 | 35 | | described by Section 601.051, including a policyholder of a motor |
|---|
| 36 | 36 | | vehicle liability insurance policy covering the vehicle; |
|---|
| 37 | 37 | | (G) an insurance company that issued an insurance |
|---|
| 38 | 38 | | policy covering a vehicle involved in the accident; |
|---|
| 39 | 39 | | (H) an insurance company that issued a policy |
|---|
| 40 | 40 | | covering any person involved in the accident; |
|---|
| 41 | 41 | | (I) a person under contract to provide claims or |
|---|
| 42 | 42 | | underwriting information to a person described by Paragraph (F), |
|---|
| 43 | 43 | | (G), or (H); |
|---|
| 44 | 44 | | (J) a radio or television station that holds a |
|---|
| 45 | 45 | | license issued by the Federal Communications Commission; |
|---|
| 46 | 46 | | (K) a newspaper that is: |
|---|
| 47 | 47 | | (i) a free newspaper of general circulation |
|---|
| 48 | 48 | | or qualified under Section 2051.044, Government Code, to publish |
|---|
| 49 | 49 | | legal notices; |
|---|
| 50 | 50 | | (ii) published at least once a week; and |
|---|
| 51 | 51 | | (iii) available and of interest to the |
|---|
| 52 | 52 | | general public in connection with the dissemination of news; [or] |
|---|
| 53 | 53 | | (L) any person who may sue because of death |
|---|
| 54 | 54 | | resulting from the accident; or |
|---|
| 55 | 55 | | (M) the first lienholder of a vehicle damaged in |
|---|
| 56 | 56 | | the accident, including: |
|---|
| 57 | 57 | | (i) a vehicle storage facility that is |
|---|
| 58 | 58 | | licensed under Chapter 2303, Occupations Code, and is the first |
|---|
| 59 | 59 | | lienholder of the vehicle; and |
|---|
| 60 | 60 | | (ii) a towing company that is licensed |
|---|
| 61 | 61 | | under Chapter 2308, Occupations Code, and is the first lienholder |
|---|
| 62 | 62 | | of the vehicle. |
|---|
| 63 | 63 | | SECTION 2. This Act takes effect September 1, 2017. |
