55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the premium surcharge certain automobile insurers are
88 required to assess against an insured convicted of certain
99 offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1953.052(a), Insurance Code, is amended
1212 to read as follows:
1313 (a) An insurer described by Section 1952.001 shall assess a
1414 premium surcharge in an amount as stated in the insurer's rating
1515 plan [prescribed by the department] against an insured for no more
1616 than three years immediately following the date the insured is
1717 convicted of:
1818 (1) an offense relating to the operating of a motor
1919 vehicle while intoxicated in violation of Section 49.04 or 49.07,
2020 Penal Code; or
2121 (2) an offense under Section 49.08, Penal Code.
2222 SECTION 2. This Act takes effect September 1, 2017.
