11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
---|
13 | 11 | | is amended by adding Section 32.0317 to read as follows: |

14 | 12 | | Sec. 32.0317. PERIOD FOR FILING REIMBURSEMENT CLAIMS BY |
---|
15 | 13 | | CERTAIN ANCILLARY SERVICE PROVIDERS. (a) In this section, |
---|
16 | 14 | | "ancillary service" means a health care service provided or ordered |
---|
17 | 15 | | by a physician or other health care provider to supplement or |
---|
18 | 16 | | support the evaluation or treatment of a patient, including a |
---|
19 | 17 | | diagnostic ultrasound test, laboratory test, cardiac diagnostic |
---|
20 | 18 | | test, or radiology service. |
---|
21 | 19 | | (b) In adopting rules governing the period for filing claims |
---|
22 | 20 | | for reimbursement under the medical assistance program, the |
---|
23 | 21 | | executive commissioner shall ensure that a provider of an ancillary |
---|
24 | 22 | | service to a recipient who is homebound, as defined by rule by the |
---|
25 | 23 | | executive commissioner, or who resides in a nursing facility may |
---|
26 | 24 | | file a claim for reimbursement for that service with the |
---|
27 | 25 | | commission, the commission's designee, a managed care |
---|
28 | 26 | | organization, or other person, as appropriate, on or before the |
---|
29 | 27 | | 270th day after the date the ancillary service is provided. |
---|
30 | 28 | | SECTION 2. The executive commissioner of the Health and |
---|
31 | 29 | | Human Services Commission shall adopt the rules necessary to |
---|
32 | 30 | | implement Section 32.0317, Human Resources Code, as added by this |
---|
33 | 31 | | Act, not later than January 1, 2018. |
---|
34 | 32 | | SECTION 3. If before implementing any provision of this Act |
---|
35 | 33 | | a state agency determines that a waiver or authorization from a |
---|
36 | 34 | | federal agency is necessary for implementation of that provision, |
---|
37 | 35 | | the agency affected by the provision shall request the waiver or |
---|
38 | 36 | | authorization and may delay implementing that provision until the |
---|
39 | 37 | | waiver or authorization is granted. |
---|
40 | 38 | | SECTION 4. This Act takes effect September 1, 2017. |
