97 relating to the period for filing a claim for reimbursement for
108 certain ancillary services under the Medicaid program.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1311 is amended by adding Section 32.0317 to read as follows:
1412 Sec. 32.0317. PERIOD FOR FILING REIMBURSEMENT CLAIMS BY
1513 CERTAIN ANCILLARY SERVICE PROVIDERS. (a) In this section,
1614 "ancillary service" means a health care service provided or ordered
1715 by a physician or other health care provider to supplement or
1816 support the evaluation or treatment of a patient, including a
1917 diagnostic ultrasound test, laboratory test, cardiac diagnostic
2018 test, or radiology service.
2119 (b) In adopting rules governing the period for filing claims
2220 for reimbursement under the medical assistance program, the
2321 executive commissioner shall ensure that a provider of an ancillary
2422 service to a recipient who is homebound, as defined by rule by the
2523 executive commissioner, or who resides in a nursing facility may
2624 file a claim for reimbursement for that service with the
2725 commission, the commission's designee, a managed care
2826 organization, or other person, as appropriate, on or before the
2927 270th day after the date the ancillary service is provided.
3028 SECTION 2. The executive commissioner of the Health and
3129 Human Services Commission shall adopt the rules necessary to
3230 implement Section 32.0317, Human Resources Code, as added by this
3331 Act, not later than January 1, 2018.
3432 SECTION 3. If before implementing any provision of this Act
3533 a state agency determines that a waiver or authorization from a
3634 federal agency is necessary for implementation of that provision,
3735 the agency affected by the provision shall request the waiver or
3836 authorization and may delay implementing that provision until the
3937 waiver or authorization is granted.
4038 SECTION 4. This Act takes effect September 1, 2017.
