88 AN ACT
99 relating to the fee collected for an on-site wastewater treatment
1010 permit application.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 367.008(b) and (c), Health and Safety
1313 Code, are amended to read as follows:
1414 (b) The commission shall [may] award competitive grants
1515 to[:
1616 [(1)] support applied research and demonstration
1717 projects by accredited colleges and universities in this state, by
1818 other governmental entities, or by acceptable public or private
1919 research centers regarding on-site wastewater treatment technology
2020 and systems applicable to this state that are directed toward
2121 improving the quality of wastewater treatment and reducing the cost
2222 of providing wastewater treatment to consumers, including
2323 wastewater reuse [; and
2424 [(2) enhance technology transfer regarding on-site
2525 wastewater treatment by using educational courses, seminars,
2626 symposia, publications, and other forms of information
2727 dissemination].
2828 (c) The commission shall seek the advice of relevant experts
2929 when choosing research topics and [,] awarding grants[, and holding
3030 educational conferences associated with activities] under this
3131 chapter.
3232 SECTION 2. Section 367.010(d), Health and Safety Code, is
3333 amended to read as follows:
3434 (d) The fee proceeds shall be deposited to the credit of the
3535 water resources management account and may be used only for the
3636 purposes of Sections 367.007 and 367.008.
3737 SECTION 3. Section 5.701(p), Water Code, is amended to read
3838 as follows:
3939 (p) Notwithstanding any other law, fees collected for
4040 deposit to the water resource management account under the
4141 following statutes may be appropriated and used to protect water
4242 resources in this state, including assessment of water quality,
4343 reasonably related to the activities of any of the persons required
4444 to pay a fee under:
4545 (1) Subsection (b), to the extent those fees are paid
4646 by water districts, and Subsections (e), (f), and (n); or
4747 (2) Section 54.037(c) [; or
4848 [(3) Section 367.010, Health and Safety Code].
4949 SECTION 4. (a) The changes in law made by this Act apply
5050 only to an application for an on-site wastewater treatment permit
5151 received by the Texas Commission on Environmental Quality or an
5252 authorized agent, as defined by Section 366.002, Health and Safety
5353 Code, on or after the effective date of this Act. An application
5454 received before the effective date of this Act is governed by the
5555 law in effect on the date the application was received, and the
5656 former law is continued in effect for that purpose.
5757 (b) The changes in law made by this Act apply only to an
5858 application for a grant under Section 367.008, Health and Safety
5959 Code, as amended by this Act, submitted on or after the effective
6060 date of this Act. An application for a grant submitted before the
6161 effective date of this Act is governed by the law in effect on the
6262 date the application was submitted, and the former law is continued
6363 in effect for that purpose.
6464 SECTION 5. This Act takes effect September 1, 2017.
