11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Sections 367.008(b) and (c), Health and Safety |
---|
13 | 13 | | Code, are amended to read as follows: |
---|
14 | 14 | | (b) The commission shall [may] award competitive grants |
---|
15 | 15 | | to[: |
---|
16 | 16 | | [(1)] support applied research and demonstration |
---|
17 | 17 | | projects by accredited colleges and universities in this state, by |
---|
18 | 18 | | other governmental entities, or by acceptable public or private |
---|
19 | 19 | | research centers regarding on-site wastewater treatment technology |
---|
20 | 20 | | and systems applicable to this state that are directed toward |
---|
21 | 21 | | improving the quality of wastewater treatment and reducing the cost |
---|
22 | 22 | | of providing wastewater treatment to consumers, including |
---|
23 | 23 | | wastewater reuse [; and |
---|
24 | 24 | | [(2) enhance technology transfer regarding on-site |
---|
25 | 25 | | wastewater treatment by using educational courses, seminars, |
---|
26 | 26 | | symposia, publications, and other forms of information |
---|
27 | 27 | | dissemination]. |
---|
28 | 28 | | (c) The commission shall seek the advice of relevant experts |
---|
29 | 29 | | when choosing research topics and [,] awarding grants[, and holding |
---|
30 | 30 | | educational conferences associated with activities] under this |
---|
31 | 31 | | chapter. |
---|
32 | 32 | | SECTION 2. Section 367.010(d), Health and Safety Code, is |
---|
33 | 33 | | amended to read as follows: |
---|
34 | 34 | | (d) The fee proceeds shall be deposited to the credit of the |
---|
35 | 35 | | water resources management account and may be used only for the |
---|
36 | 36 | | purposes of Sections 367.007 and 367.008. |
---|
37 | 37 | | SECTION 3. Section 5.701(p), Water Code, is amended to read |
---|
38 | 38 | | as follows: |
---|
39 | 39 | | (p) Notwithstanding any other law, fees collected for |
---|
40 | 40 | | deposit to the water resource management account under the |
---|
41 | 41 | | following statutes may be appropriated and used to protect water |
---|
42 | 42 | | resources in this state, including assessment of water quality, |
---|
43 | 43 | | reasonably related to the activities of any of the persons required |
---|
44 | 44 | | to pay a fee under: |
---|
45 | 45 | | (1) Subsection (b), to the extent those fees are paid |
---|
46 | 46 | | by water districts, and Subsections (e), (f), and (n); or |
---|
47 | 47 | | (2) Section 54.037(c) [; or |
---|
48 | 48 | | [(3) Section 367.010, Health and Safety Code]. |
---|
49 | 49 | | SECTION 4. (a) The changes in law made by this Act apply |
---|
50 | 50 | | only to an application for an on-site wastewater treatment permit |
---|
51 | 51 | | received by the Texas Commission on Environmental Quality or an |
---|
52 | 52 | | authorized agent, as defined by Section 366.002, Health and Safety |
---|
53 | 53 | | Code, on or after the effective date of this Act. An application |
---|
54 | 54 | | received before the effective date of this Act is governed by the |
---|
55 | 55 | | law in effect on the date the application was received, and the |
---|
56 | 56 | | former law is continued in effect for that purpose. |
---|
57 | 57 | | (b) The changes in law made by this Act apply only to an |
---|
58 | 58 | | application for a grant under Section 367.008, Health and Safety |
---|
59 | 59 | | Code, as amended by this Act, submitted on or after the effective |
---|
60 | 60 | | date of this Act. An application for a grant submitted before the |
---|
61 | 61 | | effective date of this Act is governed by the law in effect on the |
---|
62 | 62 | | date the application was submitted, and the former law is continued |
---|
63 | 63 | | in effect for that purpose. |
---|
64 | 64 | | SECTION 5. This Act takes effect September 1, 2017. |
