66 AN ACT
77 relating to supplemental pay for certain employees of the
88 Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Section 40.0331 to read as follows:
1212 Sec. 40.0331. SUPPLEMENTAL PAY FOR PROFICIENCY IN A FOREIGN
1313 LANGUAGE. (a) In this section, "employee" means a person who is
1414 employed by the department as:
1515 (1) a direct delivery caseworker in the adult
1616 protective services, child protective services, child care
1717 licensing, or statewide intake division of the department;
1818 (2) a human services technician in the child
1919 protective services division of the department; or
2020 (3) an administrative assistant in the adult
2121 protective services, child protective services, child care
2222 licensing, or statewide intake division of the department.
2323 (b) The department shall pay a supplement not to exceed 6.8
2424 percent of the employee's base salary to an employee who is
2525 proficient in both English and a second language if:
2626 (1) the executive commissioner determines that:
2727 (A) proficiency in the second language is
2828 beneficial to serving the department's clients; and
2929 (B) there is not an efficient alternative
3030 available to meet the department's needs; and
3131 (2) the employee is able to demonstrate proficiency in
3232 the second language by demonstrating reading, writing, and
3333 conversation skills as determined by the department.
3434 (c) Supplemental pay to an employee under this section is in
3535 addition to the employee's regular compensation.
3636 (d) The executive commissioner shall develop a procedure to
3737 determine an employee's foreign language proficiency for purposes
3838 of Subsection (b), including establishing or adopting a foreign
3939 language proficiency exam.
4040 (e) The department shall assume the costs associated with
4141 administering the foreign language proficiency exam established or
4242 adopted under Subsection (d) to employees.
4343 (f) The division, district, or regional director of the
4444 department where an employee is located shall determine whether the
4545 employee in the division, district, or region is eligible under
4646 Subsection (b) to receive supplemental pay. The manager or
4747 supervisor of the employee shall verify that an employee who
4848 applies to receive supplemental payments under this section meets
4949 the eligibility requirements under Subsection (b) before approving
5050 supplemental pay and that qualified employees receive supplemental
5151 payments.
5252 (g) An employee may apply to receive supplemental pay under
5353 this section at any time during the employee's active employment
5454 with the department.
5555 (h) Supplemental pay given to employees under this section
5656 must comply with human resources policies of the commission and
5757 salary guidelines for the department.
5858 (i) The department shall include information about the
5959 supplemental pay available to a qualified employee under this
6060 section in employment application forms and new employee
6161 orientation presentations.
6262 SECTION 2. Not later than September 1, 2019, the executive
6363 commissioner of the Health and Human Services Commission shall
6464 adopt rules to implement Section 40.0331, Human Resources Code, as
6565 added by this Act.
6666 SECTION 3. This Act takes effect immediately if it receives
6767 a vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution. If this
6969 Act does not receive the vote necessary for immediate effect, this
7070 Act takes effect September 1, 2017.
