66 AN ACT
77 relating to an acute psychiatric bed registry to list available
88 beds for emergency detention and treatment of certain individuals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 533, Health and Safety
1111 Code, is amended by adding Section 533.054 to read as follows:
1212 Sec. 533.054. ACUTE PSYCHIATRIC BED REGISTRY. (a) In this
1313 section, "inpatient mental health facility" has the meaning
1414 assigned by Section 571.003.
1515 (b) The department shall develop and administer a web-based
1616 and searchable acute psychiatric bed registry to collect,
1717 aggregate, and display information about beds at inpatient mental
1818 health facilities that are available for the temporary detention
1919 and treatment of individuals under Chapter 573.
2020 (c) For each inpatient mental health facility, the acute
2121 psychiatric bed registry must list:
2222 (1) the name and contact information of the facility;
2323 (2) the number of available beds;
2424 (3) the type of individual that may be admitted;
2525 (4) the level of security provided; and
2626 (5) any other information that may be necessary to
2727 identify appropriate beds for the temporary detention and treatment
2828 of individuals under Chapter 573.
2929 (d) The department shall make the acute psychiatric bed
3030 registry available to community service boards, mental health
3131 facilities, public and private residential crisis stabilization
3232 units, emergency care facilities, and emergency care providers.
3333 The department may make the registry available to any other person
3434 the department considers appropriate.
3535 (e) An inpatient mental health facility shall submit to the
3636 department information for the acute psychiatric bed registry as
3737 required by the department and review the information and confirm
3838 its accuracy to the department at least once daily and whenever
3939 there is a change in bed availability at the facility.
4040 (f) An inpatient mental health facility shall designate an
4141 employee or employees as necessary to:
4242 (1) submit to the department the information required
4343 under Subsection (e) and review the information as required by that
4444 subsection; and
4545 (2) serve as a contact for questions about the
4646 information submitted.
4747 (g) The department may contract with any person the
4848 department considers appropriate to develop and administer the
4949 acute psychiatric bed registry.
5050 SECTION 2. Not later than January 1, 2018, the Department of
5151 State Health Services shall establish the acute psychiatric bed
5252 registry required by Section 533.054, Health and Safety Code, as
5353 added by this Act.
5454 SECTION 3. This Act takes effect September 1, 2017.
