55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to cosmetology licensing and sanitation requirements.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1602.254, Occupations Code, is amended
1010 by adding Subsection (b-1) to read as follows:
1111 (b-1) A requirement under Subsection (b)(3) may be
1212 fulfilled, in whole or in part, by academic credit hours. The
1313 attribution of academic credit hours must be made in accordance
1414 with a formula, adopted by commission rule, that the commission
1515 determines fairly equates academic credit hours with clock hours of
1616 instruction.
1717 SECTION 2. Section 1603.102, Occupations Code, is amended
1818 to read as follows:
1919 Sec. 1603.102. SANITATION RULES. (a) The commission shall
2020 establish sanitation rules to prevent the spread of an infectious
2121 or contagious disease.
2222 (b) Rules adopted under this section applicable to an
2323 individual or facility regulated under Chapter 1602 shall be
2424 consistent with the standards and terminology related to safety and
2525 sanitation that are commonly used in the cosmetology industry.
2626 SECTION 3. Section 1603.256(c), Occupations Code, is
2727 amended to read as follows:
2828 (c) The following persons may administer a practical
2929 examination required under this subchapter:
3030 (1) the department; [or]
3131 (2) a person with whom the department contracts under
3232 Section 1603.252; or
3333 (3) a private beauty culture school or a vocational
3434 cosmetology program in a public school licensed under this chapter
3535 or Chapter 1602.
3636 SECTION 4. The change in law made by this Act to Section
3737 1603.256(c), Occupations Code, applies to an examination
3838 administered on or after the effective date of this Act. An
3939 examination administered before the effective date of this Act is
4040 governed by the law in effect on the date the examination was
4141 administered, and that law is continued in effect for that purpose.
4242 SECTION 5. This Act takes effect September 1, 2017.
