| 7 | 7 | | relating to cosmetology licensing and sanitation requirements. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1602.254, Occupations Code, is amended |
|---|
| 10 | 10 | | by adding Subsection (b-1) to read as follows: |
|---|
| 11 | 11 | | (b-1) A requirement under Subsection (b)(3) may be |
|---|
| 12 | 12 | | fulfilled, in whole or in part, by academic credit hours. The |
|---|
| 13 | 13 | | attribution of academic credit hours must be made in accordance |
|---|
| 14 | 14 | | with a formula, adopted by commission rule, that the commission |
|---|
| 15 | 15 | | determines fairly equates academic credit hours with clock hours of |
|---|
| 16 | 16 | | instruction. |

| 17 | 17 | | SECTION 2. Section 1603.102, Occupations Code, is amended |
|---|
| 18 | 18 | | to read as follows: |
|---|
| 19 | 19 | | Sec. 1603.102. SANITATION RULES. (a) The commission shall |
|---|
| 20 | 20 | | establish sanitation rules to prevent the spread of an infectious |
|---|
| 21 | 21 | | or contagious disease. |
|---|
| 22 | 22 | | (b) Rules adopted under this section applicable to an |
|---|
| 23 | 23 | | individual or facility regulated under Chapter 1602 shall be |
|---|
| 24 | 24 | | consistent with the standards and terminology related to safety and |
|---|
| 25 | 25 | | sanitation that are commonly used in the cosmetology industry. |
|---|
| 26 | 26 | | SECTION 3. Section 1603.256(c), Occupations Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (c) The following persons may administer a practical |
|---|
| 29 | 29 | | examination required under this subchapter: |
|---|
| 30 | 30 | | (1) the department; [or] |
|---|
| 31 | 31 | | (2) a person with whom the department contracts under |
|---|
| 32 | 32 | | Section 1603.252; or |
|---|
| 33 | 33 | | (3) a private beauty culture school or a vocational |
|---|
| 34 | 34 | | cosmetology program in a public school licensed under this chapter |
|---|
| 35 | 35 | | or Chapter 1602. |
|---|
| 36 | 36 | | SECTION 4. The change in law made by this Act to Section |
|---|
| 37 | 37 | | 1603.256(c), Occupations Code, applies to an examination |
|---|
| 38 | 38 | | administered on or after the effective date of this Act. An |
|---|
| 39 | 39 | | examination administered before the effective date of this Act is |
|---|
| 40 | 40 | | governed by the law in effect on the date the examination was |
|---|
| 41 | 41 | | administered, and that law is continued in effect for that purpose. |
|---|
| 42 | 42 | | SECTION 5. This Act takes effect September 1, 2017. |
