55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the secretary of state posting on the secretary of
88 state's Internet website a database containing information about
99 each holder of and candidate for all elected offices in the state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 31, Election Code, is
1212 amended by adding Section 31.013 to read as follows:
1313 Sec. 31.013. INTERNET DATABASE FOR INCUMBENTS AND
1414 CANDIDATES. (a) The secretary of state shall post on the secretary
1515 of state's Internet website a database containing information about
1616 each holder of and candidate for any elected office in this state.
1717 (b) The database must include the following information
1818 about a holder of an elected office:
1919 (1) name;
2020 (2) office title, including any district, place, or
2121 position;
2222 (3) if the office is elected at large or by district;
2323 (4) date of the previous and next election for the
2424 office;
2525 (5) public mailing address;
2626 (6) public telephone number, if available; and
2727 (7) public e-mail address, if available.
2828 (c) The database must include the following information
2929 about a candidate for an elected office:
3030 (1) name;
3131 (2) office sought, including any district, place, or
3232 position;
3333 (3) if the office is elected at large or by district;
3434 (4) date of the election;
3535 (5) public mailing address;
3636 (6) public telephone number, if available;
3737 (7) public e-mail address, if available;
3838 (8) name of the incumbent; and
3939 (9) if the candidate has filed as a write-in
4040 candidate.
4141 (d) The authority with whom a declaration of candidacy is
4242 filed, a state chair of a political party, or the presiding officer
4343 of a political party's convention shall provide information about a
4444 candidate or officeholder to the secretary of state.
4545 (e) The secretary of state may prescribe any procedures
4646 necessary to implement this section.
4747 SECTION 2. Section 52.003, Election Code, is amended by
4848 adding Subsection (d) to read as follows:
4949 (d) A candidate's name may not be printed on the ballot
5050 until the candidate's name appears on the secretary of state's
5151 Internet website as a candidate for elected office under Section
5252 31.013.
5353 SECTION 3. Section 141.032, Election Code, is amended by
5454 adding Subsection (h) to read as follows:
5555 (h) The authority with whom the application is filed shall
5656 provide the secretary of state with the candidate's information
5757 required for the secretary of state's Internet website under
5858 Section 31.013.
5959 SECTION 4. This Act takes effect September 1, 2017.
