|---|
| 9 | 9 | | each holder of and candidate for all elected offices in the state. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 31, Election Code, is |
|---|
| 12 | 12 | | amended by adding Section 31.013 to read as follows: |
|---|
| 13 | 13 | | Sec. 31.013. INTERNET DATABASE FOR INCUMBENTS AND |
|---|
| 14 | 14 | | CANDIDATES. (a) The secretary of state shall post on the secretary |
|---|
| 15 | 15 | | of state's Internet website a database containing information about |
|---|
| 16 | 16 | | each holder of and candidate for any elected office in this state. |
|---|
| 17 | 17 | | (b) The database must include the following information |
|---|
| 18 | 18 | | about a holder of an elected office: |
|---|
| 19 | 19 | | (1) name; |
|---|
| 20 | 20 | | (2) office title, including any district, place, or |
|---|
| 21 | 21 | | position; |
|---|
| 22 | 22 | | (3) if the office is elected at large or by district; |
|---|
| 23 | 23 | | (4) date of the previous and next election for the |
|---|
| 24 | 24 | | office; |
|---|
| 25 | 25 | | (5) public mailing address; |
|---|
| 26 | 26 | | (6) public telephone number, if available; and |
|---|
| 27 | 27 | | (7) public e-mail address, if available. |
|---|
| 28 | 28 | | (c) The database must include the following information |
|---|
| 29 | 29 | | about a candidate for an elected office: |
|---|
| 30 | 30 | | (1) name; |
|---|
| 31 | 31 | | (2) office sought, including any district, place, or |
|---|
| 32 | 32 | | position; |
|---|
| 33 | 33 | | (3) if the office is elected at large or by district; |
|---|
| 34 | 34 | | (4) date of the election; |
|---|
| 35 | 35 | | (5) public mailing address; |
|---|
| 36 | 36 | | (6) public telephone number, if available; |
|---|
| 37 | 37 | | (7) public e-mail address, if available; |
|---|
| 38 | 38 | | (8) name of the incumbent; and |
|---|
| 39 | 39 | | (9) if the candidate has filed as a write-in |
|---|
| 40 | 40 | | candidate. |
|---|
| 41 | 41 | | (d) The authority with whom a declaration of candidacy is |
|---|
| 42 | 42 | | filed, a state chair of a political party, or the presiding officer |
|---|
| 43 | 43 | | of a political party's convention shall provide information about a |
|---|
| 44 | 44 | | candidate or officeholder to the secretary of state. |
|---|
| 45 | 45 | | (e) The secretary of state may prescribe any procedures |
|---|
| 46 | 46 | | necessary to implement this section. |
|---|
| 47 | 47 | | SECTION 2. Section 52.003, Election Code, is amended by |
|---|
| 48 | 48 | | adding Subsection (d) to read as follows: |
|---|
| 49 | 49 | | (d) A candidate's name may not be printed on the ballot |
|---|
| 50 | 50 | | until the candidate's name appears on the secretary of state's |
|---|
| 51 | 51 | | Internet website as a candidate for elected office under Section |
|---|
| 52 | 52 | | 31.013. |
|---|
| 53 | 53 | | SECTION 3. Section 141.032, Election Code, is amended by |
|---|
| 54 | 54 | | adding Subsection (h) to read as follows: |
|---|
| 55 | 55 | | (h) The authority with whom the application is filed shall |
|---|
| 56 | 56 | | provide the secretary of state with the candidate's information |
|---|
| 57 | 57 | | required for the secretary of state's Internet website under |
|---|
| 58 | 58 | | Section 31.013. |
|---|
| 59 | 59 | | SECTION 4. This Act takes effect September 1, 2017. |
