| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 150.002, Civil Practice and Remedies |
|---|
| 13 | 13 | | Code, is amended by adding Subsection (b-1) to read as follows: |
|---|
| 14 | 14 | | (b-1) The affidavit shall set forth specifically facts |
|---|
| 15 | 15 | | sufficient to establish the affiant's familiarity or experience |
|---|
| 16 | 16 | | with the relevant practice area such that the affiant's |
|---|
| 17 | 17 | | qualifications to render an opinion on the matters set forth in the |
|---|
| 18 | 18 | | affidavit for purposes of Subsection (b) are established. The |
|---|
| 19 | 19 | | affiant must attach to the affidavit as an exhibit the affiant's |
|---|
| 20 | 20 | | curriculum vitae or a similar document sufficient to establish that |
|---|
| 21 | 21 | | the affiant meets the requirements of Subsection (a). |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an action commenced on or after the effective date of this Act. |
|---|
| 24 | 24 | | An action commenced before the effective date of this Act is |
|---|
| 25 | 25 | | governed by the law as it existed immediately before the effective |
|---|
| 26 | 26 | | date of this Act, and that law is continued in effect for that |
|---|
| 27 | 27 | | purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2017. |
