88 AN ACT
99 relating to the certificate of merit required for certain civil
1010 actions against certain licensed or registered professionals.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 150.002, Civil Practice and Remedies
1313 Code, is amended by adding Subsection (b-1) to read as follows:
1414 (b-1) The affidavit shall set forth specifically facts
1515 sufficient to establish the affiant's familiarity or experience
1616 with the relevant practice area such that the affiant's
1717 qualifications to render an opinion on the matters set forth in the
1818 affidavit for purposes of Subsection (b) are established. The
1919 affiant must attach to the affidavit as an exhibit the affiant's
2020 curriculum vitae or a similar document sufficient to establish that
2121 the affiant meets the requirements of Subsection (a).
2222 SECTION 2. The change in law made by this Act applies only
2323 to an action commenced on or after the effective date of this Act.
2424 An action commenced before the effective date of this Act is
2525 governed by the law as it existed immediately before the effective
2626 date of this Act, and that law is continued in effect for that
2727 purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
