55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution and punishment of the use of
88 benzodiazepines or gamma butyrolactone to facilitate the
99 commission of the offense of aggravated sexual assault and the
1010 addition of gamma butyrolactone to Penalty Group 1 of the Texas
1111 Controlled Substances Act for purposes of criminal prosecution;
1212 amending provisions subject to a criminal penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 22.021(a), Penal Code, is amended to
1515 read as follows:
1616 (a) A person commits an offense:
1717 (1) if the person:
1818 (A) intentionally or knowingly:
1919 (i) causes the penetration of the anus or
2020 sexual organ of another person by any means, without that person's
2121 consent;
2222 (ii) causes the penetration of the mouth of
2323 another person by the sexual organ of the actor, without that
2424 person's consent; or
2525 (iii) causes the sexual organ of another
2626 person, without that person's consent, to contact or penetrate the
2727 mouth, anus, or sexual organ of another person, including the
2828 actor; or
2929 (B) intentionally or knowingly:
3030 (i) causes the penetration of the anus or
3131 sexual organ of a child by any means;
3232 (ii) causes the penetration of the mouth of
3333 a child by the sexual organ of the actor;
3434 (iii) causes the sexual organ of a child to
3535 contact or penetrate the mouth, anus, or sexual organ of another
3636 person, including the actor;
3737 (iv) causes the anus of a child to contact
3838 the mouth, anus, or sexual organ of another person, including the
3939 actor; or
4040 (v) causes the mouth of a child to contact
4141 the anus or sexual organ of another person, including the actor; and
4242 (2) if:
4343 (A) the person:
4444 (i) causes serious bodily injury or
4545 attempts to cause the death of the victim or another person in the
4646 course of the same criminal episode;
4747 (ii) by acts or words places the victim in
4848 fear that any person will become the victim of an offense under
4949 Section 20A.02(a)(3), (4), (7), or (8) or that death, serious
5050 bodily injury, or kidnapping will be imminently inflicted on any
5151 person;
5252 (iii) by acts or words occurring in the
5353 presence of the victim threatens to cause any person to become the
5454 victim of an offense under Section 20A.02(a)(3), (4), (7), or (8) or
5555 to cause the death, serious bodily injury, or kidnapping of any
5656 person;
5757 (iv) uses or exhibits a deadly weapon in the
5858 course of the same criminal episode;
5959 (v) acts in concert with another who
6060 engages in conduct described by Subdivision (1) directed toward the
6161 same victim and occurring during the course of the same criminal
6262 episode; or
6363 (vi) administers or provides a
6464 benzodiazepine, flunitrazepam, otherwise known as rohypnol, gamma
6565 butyrolactone, gamma hydroxybutyrate, or ketamine to the victim of
6666 the offense with the intent of facilitating the commission of the
6767 offense;
6868 (B) the victim is younger than 14 years of age; or
6969 (C) the victim is an elderly individual or a
7070 disabled individual.
7171 SECTION 2. Section 22.021(b), Penal Code, is amended by
7272 adding Subdivision (4) to read as follows:
7373 (4) "Benzodiazepine" means any drug included in the
7474 class of drugs of the same name, that:
7575 (A) produce a depressant effect on the central
7676 nervous system; and
7777 (B) are characterized by a benzene ring fused to
7878 a seven-member diazepine ring.
7979 SECTION 3. Section 481.102, Health and Safety Code, is
8080 amended to read as follows:
8181 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:
8282 (1) the following opiates, including their isomers,
8383 esters, ethers, salts, and salts of isomers, esters, and ethers,
8484 unless specifically excepted, if the existence of these isomers,
8585 esters, ethers, and salts is possible within the specific chemical
8686 designation:
8787 Alfentanil;
8888 Allylprodine;
8989 Alphacetylmethadol;
9090 Benzethidine;
9191 Betaprodine;

257257 SECTION 4. The change in law made by this Act applies only
258258 to an offense committed on or after the effective date of this Act.
259259 An offense committed before the effective date of this Act is
260260 governed by the law in effect on the date the offense was committed,
261261 and the former law is continued in effect for that purpose. For
262262 purposes of this section, an offense was committed before the
263263 effective date of this Act if any element of the offense occurred
264264 before that date.
265265 SECTION 5. This Act takes effect September 1, 2017.
