6	6	AN ACT
7	7	relating to the prosecution and punishment of the use of
8	8	benzodiazepines or gamma butyrolactone to facilitate the
9	9	commission of the offense of aggravated sexual assault and the
10	10	addition of gamma butyrolactone to Penalty Group 1 of the Texas
11	11	Controlled Substances Act for purposes of criminal prosecution;
12	12	amending provisions subject to a criminal penalty.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 22.021(a), Penal Code, is amended to
15	15	read as follows:
16	16	(a) A person commits an offense:
17	17	(1) if the person:
18	18	(A) intentionally or knowingly:
19	19	(i) causes the penetration of the anus or
20	20	sexual organ of another person by any means, without that person's
21	21	consent;
22	22	(ii) causes the penetration of the mouth of
23	23	another person by the sexual organ of the actor, without that
24	24	person's consent; or
25	25	(iii) causes the sexual organ of another
26	26	person, without that person's consent, to contact or penetrate the
27	27	mouth, anus, or sexual organ of another person, including the
28	28	actor; or
29	29	(B) intentionally or knowingly:
30	30	(i) causes the penetration of the anus or
31	31	sexual organ of a child by any means;
32	32	(ii) causes the penetration of the mouth of
33	33	a child by the sexual organ of the actor;
34	34	(iii) causes the sexual organ of a child to
35	35	contact or penetrate the mouth, anus, or sexual organ of another
36	36	person, including the actor;
37	37	(iv) causes the anus of a child to contact
38	38	the mouth, anus, or sexual organ of another person, including the
39	39	actor; or
40	40	(v) causes the mouth of a child to contact
41	41	the anus or sexual organ of another person, including the actor; and
42	42	(2) if:
43	43	(A) the person:
44	44	(i) causes serious bodily injury or
45	45	attempts to cause the death of the victim or another person in the
46	46	course of the same criminal episode;
47	47	(ii) by acts or words places the victim in
48	48	fear that any person will become the victim of an offense under
49	49	Section 20A.02(a)(3), (4), (7), or (8) or that death, serious
50	50	bodily injury, or kidnapping will be imminently inflicted on any
51	51	person;
52	52	(iii) by acts or words occurring in the
53	53	presence of the victim threatens to cause any person to become the
54	54	victim of an offense under Section 20A.02(a)(3), (4), (7), or (8) or
55	55	to cause the death, serious bodily injury, or kidnapping of any
56	56	person;
57	57	(iv) uses or exhibits a deadly weapon in the
58	58	course of the same criminal episode;
59	59	(v) acts in concert with another who
60	60	engages in conduct described by Subdivision (1) directed toward the
61	61	same victim and occurring during the course of the same criminal
62	62	episode; or
63	63	(vi) administers or provides a
64	64	benzodiazepine, flunitrazepam, otherwise known as rohypnol, gamma
65	65	butyrolactone, gamma hydroxybutyrate, or ketamine to the victim of
66	66	the offense with the intent of facilitating the commission of the
67	67	offense;
68	68	(B) the victim is younger than 14 years of age; or
69	69	(C) the victim is an elderly individual or a
70	70	disabled individual.
71	71	SECTION 2. Section 22.021(b), Penal Code, is amended by
72	72	adding Subdivision (4) to read as follows:
73	73	(4) "Benzodiazepine" means any drug included in the
74	74	class of drugs of the same name, that:
75	75	(A) produce a depressant effect on the central
76	76	nervous system; and
77	77	(B) are characterized by a benzene ring fused to
78	78	a seven-member diazepine ring.
79	79	SECTION 3. Section 481.102, Health and Safety Code, is
80	80	amended to read as follows:
81	81	Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:
82	82	(1) the following opiates, including their isomers,
83	83	esters, ethers, salts, and salts of isomers, esters, and ethers,
84	84	unless specifically excepted, if the existence of these isomers,
85	85	esters, ethers, and salts is possible within the specific chemical
86	86	designation:
87	87	Alfentanil;
88	88	Allylprodine;
89	89	Alphacetylmethadol;
90	90	Benzethidine;
91	91	Betaprodine;
92	92	Clonitazene;
93	93	Diampromide;

257	257	SECTION 4. The change in law made by this Act applies only
258	258	to an offense committed on or after the effective date of this Act.
259	259	An offense committed before the effective date of this Act is
260	260	governed by the law in effect on the date the offense was committed,
261	261	and the former law is continued in effect for that purpose. For
262	262	purposes of this section, an offense was committed before the
263	263	effective date of this Act if any element of the offense occurred
264	264	before that date.
265	265	SECTION 5. This Act takes effect September 1, 2017.
