| 8 | 8 | | guard companies under the Private Security Act. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 1702, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 1702.1305 to read as follows: |
|---|
| 12 | 12 | | Sec. 1702.1305. REQUIREMENTS FOR USE OF INSIGNIAS AND |
|---|
| 13 | 13 | | DESIGNS BY GUARD COMPANIES. (a) This section applies only to a |
|---|
| 14 | 14 | | person who holds a security services contractor license and acts |
|---|
| 15 | 15 | | as, offers to provide the services of, or engages in the business of |
|---|
| 16 | 16 | | a guard company. |
|---|
| 17 | 17 | | (b) A person may not use an insignia or design on a uniform |
|---|
| 18 | 18 | | or motor vehicle that will be used by the person or the person's |
|---|
| 19 | 19 | | officer, director, partner, manager, or employee while performing |
|---|
| 20 | 20 | | duties as a guard company under this chapter unless the person: |
|---|
| 21 | 21 | | (1) submits the insignia or design to the department; |
|---|
| 22 | 22 | | and |
|---|
| 23 | 23 | | (2) obtains the department's approval to use the |
|---|
| 24 | 24 | | insignia or design on the uniform or motor vehicle. |
|---|
| 25 | 25 | | (c) The board by rule shall prescribe procedures for the |
|---|
| 26 | 26 | | submission and approval of an insignia or design under this |
|---|
| 27 | 27 | | section. |
|---|
| 28 | 28 | | (d) The rules may require that a person subject to this |
|---|
| 29 | 29 | | section submit a proposed insignia or design for department |
|---|
| 30 | 30 | | approval as a part of the person's application for a license if the |
|---|
| 31 | 31 | | person intends to use an insignia or design in the manner described |
|---|
| 32 | 32 | | by Subsection (b). |
|---|
| 33 | 33 | | (e) The board may not renew the license of a person who |
|---|
| 34 | 34 | | violates this section or a rule adopted under this section. |
|---|
| 35 | 35 | | SECTION 2. Not later than March 31, 2018, the Texas Private |
|---|
| 36 | 36 | | Security Board shall adopt rules to implement Section 1702.1305, |
|---|
| 37 | 37 | | Occupations Code, as added by this Act. |
|---|
| 38 | 38 | | SECTION 3. Section 1702.1305(e), Occupations Code, as added |
|---|
| 39 | 39 | | by this Act, applies only to the renewal of a security services |
|---|
| 40 | 40 | | contractor license that expires on or after September 1, 2018. A |
|---|
| 41 | 41 | | security services contractor license that expires before that date |
|---|
| 42 | 42 | | is governed by the law in effect immediately before the effective |
|---|
| 43 | 43 | | date of this Act, and the former law is continued in effect for that |
|---|
| 44 | 44 | | purpose. |
|---|
| 45 | 45 | | SECTION 4. (a) Except as provided by Subsection (b) of this |
|---|
| 46 | 46 | | section, this Act takes effect September 1, 2017. |
|---|
| 47 | 47 | | (b) Section 1702.1305, Occupations Code, as added by this |
|---|
| 48 | 48 | | Act, takes effect September 1, 2018. |
