55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of theft.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1010 as follows:
1111 (e) Except as provided by Subsection (f), an offense under
1212 this section is:
1313 (1) a Class C misdemeanor if the value of the property
1414 stolen is less than $100;
1515 (2) a Class B misdemeanor if:
1616 (A) the value of the property stolen is $100 or
1717 more but less than $750;
1818 (B) the value of the property stolen is less than
1919 $100 and the defendant has previously been convicted of any grade of
2020 theft; or
2121 (C) the property stolen is a driver's license,
2222 commercial driver's license, or personal identification
2323 certificate issued by this state or another state;
2424 (3) a Class A misdemeanor if:
2525 (A) the value of the property stolen is $750 or
2626 more but less than $2,500; or
2727 (B) the value of the property stolen is less than
2828 $100 and the defendant has been previously convicted two or more
2929 times of any grade of theft;
3030 (4) a state jail felony if:
3131 (A) the value of the property stolen is $2,500 or
3232 more but less than $30,000, or the property is less than 10 head of
3333 sheep, swine, or goats or any part thereof under the value of
3434 $30,000;
3535 (B) regardless of value, the property is stolen
3636 from the person of another or from a human corpse or grave,
3737 including property that is a military grave marker;
3838 (C) the property stolen is a firearm, as defined
3939 by Section 46.01;
4040 (D) the value of the property stolen is $100 or
4141 more but less than $2,500 and the defendant has been previously
4242 convicted two or more times of any grade of theft;
4343 (E) the property stolen is an official ballot or
4444 official carrier envelope for an election; or
4545 (F) the value of the property stolen is less than
4646 $20,000 and the property stolen is:
4747 (i) aluminum;
4848 (ii) bronze;
4949 (iii) copper; or
5050 (iv) brass;
5151 (5) a felony of the third degree if the value of the
5252 property stolen is $30,000 or more but less than $150,000, or the
5353 property is:
5454 (A) cattle, horses, or exotic livestock or exotic
5555 fowl as defined by Section 142.001, Agriculture Code, stolen during
5656 a single transaction and having an aggregate value of less than
5757 $150,000; or
5858 (B) 10 or more head of sheep, swine, or goats
5959 stolen during a single transaction and having an aggregate value of
6060 less than $150,000;
6161 (6) a felony of the second degree if:
6262 (A) the value of the property stolen is $150,000
6363 or more but less than $300,000; or
6464 (B) the value of the property stolen is less than
6565 $300,000 and the property stolen is an automated teller machine or
6666 the contents or components of an automated teller machine; or
6767 (7) a felony of the first degree if the value of the
6868 property stolen is $300,000 or more.
6969 SECTION 2. The changes in law made by this Act apply only to
7070 an offense committed on or after the effective date of this Act. An
7171 offense committed before the effective date of this Act is governed
7272 by the law in effect on the date the offense was committed, and the
7373 former law is continued in effect for that purpose. For purposes of
7474 this section, an offense was committed before the effective date of
7575 this Act if any element of the offense occurred before that date.
7676 SECTION 3. This Act takes effect September 1, 2017.
