5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to a report on the consolidation of the health and human
8	8	services system, including advisory committees within the system,
9	9	and the re-creation of the Texas system of care framework.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 531.251, Government Code, is reenacted
12	12	to read as follows:
13	13	Sec. 531.251. TEXAS SYSTEM OF CARE FRAMEWORK. (a) In this
14	14	section:
15	15	(1) "Minor" means an individual younger than 18 years
16	16	of age.
17	17	(2) "Serious emotional disturbance" means a mental,
18	18	behavioral, or emotional disorder of sufficient duration to result
19	19	in functional impairment that substantially interferes with or
20	20	limits a person's role or ability to function in family, school, or
21	21	community activities.
22	22	(3) "System of care framework" means a framework for
23	23	collaboration among state agencies, minors who have a serious
24	24	emotional disturbance or are at risk of developing a serious
25	25	emotional disturbance, and the families of those minors that
26	26	improves access to services and delivers effective community-based
27	27	services that are family-driven, youth- or young adult-guided, and
28	28	culturally and linguistically competent.
29	29	(b) The commission shall implement a system of care
30	30	framework to develop local mental health systems of care in
31	31	communities for minors who are receiving residential mental health
32	32	services and supports or inpatient mental health hospitalization,
33	33	have or are at risk of developing a serious emotional disturbance,
34	34	or are at risk of being removed from the minor's home and placed in a
35	35	more restrictive environment to receive mental health services and
36	36	supports, including an inpatient mental health hospital, a
37	37	residential treatment facility, or a facility or program operated
38	38	by the Department of Family and Protective Services or an agency
39	39	that is part of the juvenile justice system.
40	40	(c) The commission shall:
41	41	(1) maintain a comprehensive plan for the delivery of
42	42	mental health services and supports to a minor and a minor's family
43	43	using a system of care framework, including best practices in the
44	44	financing, administration, governance, and delivery of those
45	45	services;
46	46	(2) enter memoranda of understanding with the
47	47	Department of State Health Services, the Department of Family and
48	48	Protective Services, the Texas Education Agency, the Texas Juvenile
49	49	Justice Department, and the Texas Correctional Office on Offenders
50	50	with Medical or Mental Impairments that specify the roles and
51	51	responsibilities of each agency in implementing the comprehensive
52	52	plan described by Subdivision (1);
53	53	(3) identify appropriate local, state, and federal
54	54	funding sources to finance infrastructure and mental health
55	55	services and supports needed to support state and local system of
56	56	care framework efforts;
57	57	(4) develop an evaluation system to measure
58	58	cross-system performance and outcomes of state and local system of
59	59	care framework efforts; and
60	60	(5) in implementing the provisions of this section,
61	61	consult with stakeholders, including:
62	62	(A) minors who have or are at risk of developing a
63	63	serious emotional disturbance or young adults who received mental
64	64	health services and supports as a minor with or at risk of
65	65	developing a serious emotional disturbance; and
66	66	(B) family members of those minors or young
67	67	adults.
68	68	SECTION 2. Not later than July 31, 2018, the executive
69	69	commissioner of the Health and Human Services Commission shall
70	70	submit to the Health and Human Services Transition Legislative
71	71	Oversight Committee a report that includes:
72	72	(1) the latest information available on the
73	73	commission's progress in transferring and consolidating the
74	74	administrative support services functions of the health and human
75	75	services system as mandated by Subchapter A-1, Chapter 531,
76	76	Government Code; and
77	77	(2) recommendations on:
78	78	(A) whether to abolish each statutory advisory
79	79	committee that considers issues related to the health and human
80	80	services system; and
81	81	(B) for an advisory committee for which
82	82	abolishment is recommended, whether to reestablish the advisory
83	83	committee by rule, consolidate the advisory committee with another
84	84	advisory committee, or permanently discontinue the advisory
85	85	committee in any form.
86	86	SECTION 3. This Act takes effect immediately if it receives
87	87	a vote of two-thirds of all the members elected to each house, as
88	88	provided by Section 39, Article III, Texas Constitution. If this
89	89	Act does not receive the vote necessary for immediate effect, this
90	90	Act takes effect September 1, 2017.
