55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a proxy for a member of the legislature visiting a
88 facility operated by the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.010, Government Code, is amended by
1111 amending Subsection (a-1) and adding Subsection (a-2) to read as
1212 follows:
1313 (a-1) The institutional division shall allow the governor,
1414 members of the legislature, persons designated under Subsection
1515 (a-2), and members of the executive and judicial branches to enter
1616 at proper hours any part of a facility operated by the division
1717 where inmates are housed or worked[,] for the purpose of observing
1818 the operations of the division. A visitor described by this
1919 subsection may talk with inmates away from institutional division
2020 employees.
2121 (a-2) A member of the legislature may designate a person to
2222 serve as the member's proxy for the purpose of observing the
2323 operations of the institutional division as authorized by
2424 Subsection (a-1). A designation made under this subsection is
2525 valid until the earlier of:
2626 (1) the second anniversary of the date that the person
2727 is designated under this subsection; or
2828 (2) the date the member ceases to be a member of the
2929 legislature.
3030 SECTION 2. Section 507.030, Government Code, is amended by
3131 amending Subsection (a-1) and adding Subsection (a-2) to read as
3232 follows:
3333 (a-1) The state jail division shall allow the governor,
3434 members of the legislature, persons designated under Subsection
3535 (a-2), and officials of the executive and judicial branches to
3636 enter during business hours any part of a facility operated by the
3737 division[,] for the purpose of observing the operations of the
3838 division. A visitor described by this subsection may talk with
3939 defendants away from division employees.
4040 (a-2) A member of the legislature may designate a person to
4141 serve as the member's proxy for the purpose of observing the
4242 operations of the state jail division as authorized by Subsection
4343 (a-1). A designation made under this subsection is valid until the
4444 earlier of:
4545 (1) the second anniversary of the date that the person
4646 is designated under this subsection; or
4747 (2) the date the member ceases to be a member of the
4848 legislature.
4949 SECTION 3. This Act takes effect September 1, 2017.
