1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to prohibiting political contributions and political
1313 expenditures made by certain persons with public funds; creating a
1414 criminal offense.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter A, Chapter 253, Election Code, is
1717 amended by adding Section 253.007 to read as follows:
1818 Sec. 253.007. UNLAWFUL USE OF PUBLIC FUNDS FOR
1919 CONTRIBUTIONS OR EXPENDITURES. (a) An officer or employee of a
2020 political subdivision may not spend or authorize the spending of
2121 public funds to make a political contribution or a political
2222 expenditure.
2323 (b) An officer or employee of a political subdivision may
2424 not directly or indirectly employ a person to use public funds to
2525 make an unlawful political contribution or political expenditure.
2626 (c) A person who violates Subsection (a) or (b) commits an
2727 offense. An offense under this section is a Class A misdemeanor.
2828 SECTION 2. Section 253.007, Election Code, as added by this
2929 Act, applies only to a political contribution or a political
3030 expenditure made on or after the effective date of this Act.
3131 SECTION 3. This Act takes effect September 1, 2017.
