A BILL TO BE ENTITLED
AN ACT
relating to approval by the comptroller of public accounts of
certain contingent fee legal services contracts entered into by
public agencies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 403.0305, Government Code, is amended to
read as follows:
Sec. 403.0305. APPROVAL BY COMPTROLLER. A public agency as
defined under Section 30.003(3), Water Code, may not enter into a
contract as provided by Subchapter C, Chapter 2254, to bring a suit
under the Water Code in which the Texas Commission on Environmental
Quality is a necessary and indispensable party without review and
approval of the contract by the comptroller.
SECTION 2. The change in law made by this Act applies only
to a contract entered into on or after the effective date of this
Act. A contract entered into before the effective date of this Act
is governed by the law applicable to the contract immediately
before the effective date of this Act, and that law is continued in
effect for that purpose.
SECTION 3. This Act takes effect September 1, 2017.
