| 7 | 7 | | relating to approval by the comptroller of public accounts of |

| 8 | 8 | | certain contingent fee legal services contracts entered into by |
|---|
| 9 | 9 | | public agencies. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 403.0305, Government Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 403.0305. APPROVAL BY COMPTROLLER. A public agency as |
|---|
| 14 | 14 | | defined under Section 30.003(3), Water Code, may not enter into a |
|---|
| 15 | 15 | | contract as provided by Subchapter C, Chapter 2254, to bring a suit |
|---|
| 16 | 16 | | under the Water Code in which the Texas Commission on Environmental |
|---|
| 17 | 17 | | Quality is a necessary and indispensable party without review and |
|---|
| 18 | 18 | | approval of the contract by the comptroller. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 20 | | to a contract entered into on or after the effective date of this |
|---|
| 21 | 21 | | Act. A contract entered into before the effective date of this Act |
|---|
| 22 | 22 | | is governed by the law applicable to the contract immediately |
|---|
| 23 | 23 | | before the effective date of this Act, and that law is continued in |
|---|
| 24 | 24 | | effect for that purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2017. |
