| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 361.0681 to read as follows: |
|---|
| 14 | 14 | | Sec. 361.0681. DENIAL OF APPLICATION FOR CERTAIN MUNICIPAL |
|---|
| 15 | 15 | | SOLID WASTE LANDFILLS IN CERTAIN COUNTIES. The commission may not |
|---|
| 16 | 16 | | issue a permit for a new municipal solid waste landfill if: |
|---|
| 17 | 17 | | (1) the proposed site is located in a county with a |
|---|
| 18 | 18 | | population of less than 70,000 and more than 40,000 that is adjacent |
|---|
| 19 | 19 | | to a county with a population of more than 3.3 million; and |
|---|
| 20 | 20 | | (2) a previous application was submitted to the |
|---|
| 21 | 21 | | commission to operate a new municipal solid waste landfill at the |
|---|
| 22 | 22 | | same proposed site and: |
|---|
| 23 | 23 | | (A) the previous application was returned to the |
|---|
| 24 | 24 | | applicant by the commission for containing inadequate or incomplete |
|---|
| 25 | 25 | | information; and |
|---|
| 26 | 26 | | (B) the applicant for the previous application |
|---|
| 27 | 27 | | stated in writing that the previous application did not meet |
|---|
| 28 | 28 | | requirements established by commission rules. |
|---|
| 29 | 29 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 30 | 30 | | an application for the issuance of a permit pending before the Texas |
|---|
| 31 | 31 | | Commission on Environmental Quality on or after the effective date |
|---|
| 32 | 32 | | of this Act. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
