| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 41.001(a) and (c), Election Code, are |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (a) Except as otherwise provided by this subchapter, each |
|---|
| 14 | 14 | | general or special election in this state shall be held on one of |
|---|
| 15 | 15 | | the following dates: |
|---|
| 16 | 16 | | (1) the first Saturday in May in an odd-numbered year; |
|---|
| 17 | 17 | | (2) the first Saturday in May in an even-numbered |
|---|
| 18 | 18 | | year, for an election held by a district created under Section 52, |
|---|
| 19 | 19 | | Article III, or Section 59, Article XVI, Texas Constitution |
|---|
| 20 | 20 | | [political subdivision other than a county]; or |
|---|
| 21 | 21 | | (3) the first Tuesday after the first Monday in |
|---|
| 22 | 22 | | November. |
|---|
| 23 | 23 | | (c) Except for an election under Subsection (a) or Section |
|---|
| 24 | 24 | | 41.0011 [or a runoff election following an election held under |
|---|
| 25 | 25 | | Subsection (a)(2)], an election may not be held within 30 days |
|---|
| 26 | 26 | | before or after the date of the general election for state and |
|---|
| 27 | 27 | | county officers, general primary election, or runoff primary |
|---|
| 28 | 28 | | election. |

| 29 | 29 | | SECTION 2. Section 41.0052(a), Election Code, is amended to |
|---|
| 30 | 30 | | read as follows: |

| 31 | 31 | | (a) The governing body of a political subdivision, other |
|---|
| 32 | 32 | | than a county or municipal utility district, that holds its general |
|---|
| 33 | 33 | | election for officers on a date other than the November uniform |
|---|
| 34 | 34 | | election date may, not later than January 1, 2018 [December 31, |
|---|
| 35 | 35 | | 2016], change the date on which it holds its general election for |
|---|
| 36 | 36 | | officers to the November uniform election date. |
|---|
| 37 | 37 | | SECTION 3. Section 41.001(d), Election Code, is repealed. |

| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2017. |
