9- A BILL TO BE ENTITLED
104 AN ACT
115 relating to restoration of the position of public employees when
126 relieved of duty from the Texas military forces or a similar unit.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 437.202(d), Government Code, is amended
159 to read as follows:
1610 (d) An employee of this state or a municipality, a county,
1711 or another political subdivision of this state with at least five
1812 full-time employees [A state employee] who is a member of the Texas
1913 military forces, a reserve component of the armed forces, or a
2014 member of a state or federally authorized urban search and rescue
2115 team and who is ordered to duty by proper authority is entitled,
2216 when relieved from duty, to be restored to the position that the
2317 employee held when ordered to duty.
2418 SECTION 2. This Act takes effect immediately if it receives
2519 a vote of two-thirds of all the members elected to each house, as
2620 provided by Section 39, Article III, Texas Constitution. If this
2721 Act does not receive the vote necessary for immediate effect, this
2822 Act takes effect September 1, 2017.
