| 11 | 5 | | relating to restoration of the position of public employees when |
|---|
| 12 | 6 | | relieved of duty from the Texas military forces or a similar unit. |

| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 437.202(d), Government Code, is amended |
|---|
| 15 | 9 | | to read as follows: |
|---|
| 16 | 10 | | (d) An employee of this state or a municipality, a county, |
|---|
| 17 | 11 | | or another political subdivision of this state with at least five |
|---|
| 18 | 12 | | full-time employees [A state employee] who is a member of the Texas |
|---|
| 19 | 13 | | military forces, a reserve component of the armed forces, or a |
|---|
| 20 | 14 | | member of a state or federally authorized urban search and rescue |
|---|
| 21 | 15 | | team and who is ordered to duty by proper authority is entitled, |
|---|
| 22 | 16 | | when relieved from duty, to be restored to the position that the |
|---|
| 23 | 17 | | employee held when ordered to duty. |
|---|
| 24 | 18 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 22 | | Act takes effect September 1, 2017. |
