55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the mailing of a notice of intent to obtain an
88 environmental permit to certain state legislators.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5.552(b), Water Code, is amended to read
1111 as follows:
1212 (b) Not later than the 30th day after the date the executive
1313 director determines the application to be administratively
1414 complete:
1515 (1) the applicant shall publish notice of intent to
1616 obtain a permit at least once in the newspaper of largest
1717 circulation in the county in which the facility to which the
1818 application relates is located or proposed to be located or, if the
1919 facility to which the application relates is located or proposed to
2020 be located in a municipality, at least once in a newspaper of
2121 general circulation in the municipality; and
2222 (2) the chief clerk of the commission shall:
2323 (A) mail notice of intent to obtain a permit to:
2424 [(A) the state senator and representative who
2525 represent the general area in which the facility is located or
2626 proposed to be located;]
2727 (i) [(B)] the mayor and health authorities
2828 of the municipality in which the facility is located or proposed to
2929 be located;
3030 (ii) [(C)] the county judge and health
3131 authorities of the county in which the facility is located or
3232 proposed to be located; and
3333 (iii) [(D)] the river authority in which
3434 the facility is located or proposed to be located if the application
3535 is under Chapter 26, Water Code; and
3636 (B) send notice of intent to obtain a permit by
3737 certified letter, return receipt requested, to the state senator
3838 and representative who represent the general area in which the
3939 facility is located or proposed to be located.
4040 SECTION 2. The changes in law made by this Act apply only to
4141 an application for a permit that is filed with the Texas Commission
4242 on Environmental Quality on or after the effective date of this Act.
4343 An application for a permit filed before the effective date of this
4444 Act is governed by the law in effect on the date of filing, and that
4545 law is continued in effect for that purpose.
4646 SECTION 3. This Act takes effect September 1, 2017.
