55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of "non-physician mental health
88 professional" for purposes of the Texas Mental Health Code.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 571.003(15), Health and Safety Code, is
1111 amended to read as follows:
1212 (15) "Non-physician mental health professional"
1313 means:
1414 (A) a person who is:
1515 (i) a psychologist licensed to practice in
1616 this state and designated as a health-service provider;
1717 (ii) [(B)] a registered nurse with a
1818 master's or doctoral degree in psychiatric nursing;
1919 (iii) [(C)] a licensed clinical social
2020 worker;
2121 (iv) [(D)] a licensed professional
2222 counselor licensed to practice in this state; [or]
2323 (v) [(E)] a licensed marriage and family
2424 therapist licensed to practice in this state; or
2525 (vi) a licensed physician assistant; or
2626 (B) a person:
2727 (i) whose practice does not include
2828 diagnosis or psychological services typically performed by:
2929 (a) a psychologist licensed to
3030 practice in this state and designated as a health-service provider;
3131 (b) a registered nurse with a master's
3232 or doctoral degree in psychiatric nursing;
3333 (c) a licensed clinical social
3434 worker;
3535 (d) a licensed professional counselor
3636 licensed to practice in this state; or
3737 (e) a licensed marriage and family
3838 therapist licensed to practice in this state; and
3939 (ii) who is a licensed occupational
4040 therapist licensed to practice in this state.
4141 SECTION 2. This Act takes effect September 1, 2017.
