| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 571.003(15), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (15) "Non-physician mental health professional" |
|---|
| 13 | 13 | | means: |
|---|
| 14 | 14 | | (A) a person who is: |
|---|
| 15 | 15 | | (i) a psychologist licensed to practice in |
|---|
| 16 | 16 | | this state and designated as a health-service provider; |
|---|
| 17 | 17 | | (ii) [(B)] a registered nurse with a |
|---|
| 18 | 18 | | master's or doctoral degree in psychiatric nursing; |
|---|
| 19 | 19 | | (iii) [(C)] a licensed clinical social |
|---|
| 20 | 20 | | worker; |
|---|
| 21 | 21 | | (iv) [(D)] a licensed professional |
|---|
| 22 | 22 | | counselor licensed to practice in this state; [or] |
|---|
| 23 | 23 | | (v) [(E)] a licensed marriage and family |
|---|
| 24 | 24 | | therapist licensed to practice in this state; or |
|---|
| 25 | 25 | | (vi) a licensed physician assistant; or |
|---|
| 26 | 26 | | (B) a person: |
|---|
| 27 | 27 | | (i) whose practice does not include |
|---|
| 28 | 28 | | diagnosis or psychological services typically performed by: |
|---|
| 29 | 29 | | (a) a psychologist licensed to |
|---|
| 30 | 30 | | practice in this state and designated as a health-service provider; |
|---|
| 31 | 31 | | (b) a registered nurse with a master's |
|---|
| 32 | 32 | | or doctoral degree in psychiatric nursing; |
|---|
| 33 | 33 | | (c) a licensed clinical social |
|---|
| 34 | 34 | | worker; |
|---|
| 35 | 35 | | (d) a licensed professional counselor |
|---|
| 36 | 36 | | licensed to practice in this state; or |
|---|
| 37 | 37 | | (e) a licensed marriage and family |
|---|
| 38 | 38 | | therapist licensed to practice in this state; and |
|---|
| 39 | 39 | | (ii) who is a licensed occupational |
|---|
| 40 | 40 | | therapist licensed to practice in this state. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2017. |
