55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criteria for issuing a silver alert for a missing
88 senior citizen.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.386(b), Government Code, is amended
1111 to read as follows:
1212 (b) The local law enforcement agency [shall]:
1313 (1) may require the family or legal guardian of the
1414 missing senior citizen to provide documentation of the senior
1515 citizen's impaired mental condition to verify the condition as
1616 required by Subsection (a)(2)(C); and
1717 (2) shall, as soon as practicable, determine whether
1818 the senior citizen's disappearance poses a credible threat to the
1919 senior citizen's health and safety for purposes of Subsection
2020 (a)(3).
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2017.
