66 AN ACT
77 relating to employer retaliation against employees who seek
88 recovery of unpaid wages by filing a wage claim with the Texas
99 Workforce Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended
1212 by adding Section 61.021 to read as follows:
1313 Sec. 61.021. EMPLOYER RETALIATION PROHIBITED; COMPLAINT
1414 PROCEDURE. (a) An employer may not suspend or terminate the
1515 employment of or in any other manner discipline, discriminate
1616 against, or retaliate against an employee who in good faith seeks to
1717 recover wages owed to the employee by filing a wage claim under
1818 Subchapter D.
1919 (b) A person who has reason to believe that an employer has
2020 violated Subsection (a) may file a complaint with the commission.
2121 (c) On receipt of a complaint under Subsection (b), the
2222 commission shall investigate and dispose of the complaint in the
2323 same manner as a wage claim under Subchapter D. The commission may
2424 incorporate the investigation into any ongoing investigation of an
2525 underlying wage claim filed by the employee, if applicable.
2626 (d) The commission shall ensure that information regarding
2727 the complaint process under this section is available on the
2828 commission's Internet website.
2929 SECTION 2. Subchapter D, Chapter 61, Labor Code, is amended
3030 by adding Section 61.0531 to read as follows:
3131 Sec. 61.0531. RETALIATION; DAMAGES. (a) If after an
3232 investigation of a complaint under Section 61.021(b) the commission
3333 examiner, a wage claim appeal tribunal, or the commission
3434 determines that an employer violated Section 61.021(a), the
3535 examiner, tribunal, or commission shall order the employer to pay
3636 to the employee damages in an amount equal to the greater of:
3737 (1) $1,000; or
3838 (2) the amount of wages ordered to be paid in the
3939 underlying wage claim, if the payment of wages is ordered in the
4040 underlying wage claim.
4141 (b) Damages under Subsection (a) are in addition to any
4242 payment of wages ordered under this subchapter.
4343 SECTION 3. Section 61.0531, Labor Code, as added by this
4444 Act, applies only to conduct that occurs on or after the effective
4545 date of this Act. Conduct that occurs before that date is governed
4646 by the law in effect on the date the conduct occurred, and the
4747 former law is continued in effect for that purpose.
4848 SECTION 4. This Act takes effect September 1, 2017.
