66 AN ACT
77 relating to a prohibition of the land application of grit or grease
88 trap waste.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 361, Health and Safety
1111 Code, is amended by adding Section 361.1215 to read as follows:
1212 Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
1313 WASTE PROHIBITED. (a) In this section:
1414 (1) "Grease trap waste" means a material collected in
1515 and from a grease interceptor in the sanitary sewer line of a
1616 commercial, institutional, or industrial food service or
1717 processing facility. The term includes the solids resulting from a
1818 dewatering process.
1919 (2) "Grit trap" means a unit or chamber that:
2020 (A) allows the sedimentation of solids from an
2121 influent liquid stream by reducing the flow velocity of the stream;
2222 (B) has an inlet and outlet that are both located
2323 at the same vertical level at or near the top of the unit or chamber;
2424 (C) has an outlet that is connected to a sanitary
2525 sewer system; and
2626 (D) is not designed to separate oil and water.
2727 (3) "Grit trap waste" means the waste collected in a
2828 grit trap. The term includes waste from an interceptor placed in a
2929 drain at maintenance and repair shops, automobile service stations,
3030 car washes, laundries, and other similar facilities.
3131 (b) The commission may not issue a permit, registration, or
3232 other authorization for land application of grit trap waste or
3333 grease trap waste.
3434 (c) This section does not apply to a permit, registration,
3535 or other authorization issued to an entity for the disposal of
3636 grease trap waste or grit trap waste at a municipal solid waste Type
3737 I landfill, a municipal solid waste Type V facility, or a compost
3838 facility.
3939 SECTION 2. A permit, registration, or other authorization
4040 issued by the Texas Commission on Environmental Quality that allows
4141 the land application of grease trap waste or grit trap waste expires
4242 on the effective date of this Act. The remainder of a permit,
4343 registration, or other authorization that contains items in
4444 addition to an authorization allowing the land application of
4545 grease trap waste or grit trap waste remains in effect to the extent
4646 that it does not authorize the land application of grease trap waste
4747 or grit trap waste.
4848 SECTION 3. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2017.
