| 7 | 7 | | relating to a prohibition of the land application of grit or grease |

| 8 | 8 | | trap waste. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 361.1215 to read as follows: |
|---|
| 12 | 12 | | Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP |
|---|
| 13 | 13 | | WASTE PROHIBITED. (a) In this section: |
|---|
| 14 | 14 | | (1) "Grease trap waste" means a material collected in |
|---|
| 15 | 15 | | and from a grease interceptor in the sanitary sewer line of a |
|---|
| 16 | 16 | | commercial, institutional, or industrial food service or |
|---|
| 17 | 17 | | processing facility. The term includes the solids resulting from a |
|---|
| 18 | 18 | | dewatering process. |
|---|
| 19 | 19 | | (2) "Grit trap" means a unit or chamber that: |
|---|
| 20 | 20 | | (A) allows the sedimentation of solids from an |
|---|
| 21 | 21 | | influent liquid stream by reducing the flow velocity of the stream; |
|---|
| 22 | 22 | | (B) has an inlet and outlet that are both located |
|---|
| 23 | 23 | | at the same vertical level at or near the top of the unit or chamber; |
|---|
| 24 | 24 | | (C) has an outlet that is connected to a sanitary |
|---|
| 25 | 25 | | sewer system; and |
|---|
| 26 | 26 | | (D) is not designed to separate oil and water. |
|---|
| 27 | 27 | | (3) "Grit trap waste" means the waste collected in a |
|---|
| 28 | 28 | | grit trap. The term includes waste from an interceptor placed in a |
|---|
| 29 | 29 | | drain at maintenance and repair shops, automobile service stations, |
|---|
| 30 | 30 | | car washes, laundries, and other similar facilities. |
|---|
| 31 | 31 | | (b) The commission may not issue a permit, registration, or |
|---|
| 32 | 32 | | other authorization for land application of grit trap waste or |
|---|
| 33 | 33 | | grease trap waste. |
|---|
| 34 | 34 | | (c) This section does not apply to a permit, registration, |
|---|
| 35 | 35 | | or other authorization issued to an entity for the disposal of |
|---|
| 36 | 36 | | grease trap waste or grit trap waste at a municipal solid waste Type |
|---|
| 37 | 37 | | I landfill, a municipal solid waste Type V facility, or a compost |
|---|
| 38 | 38 | | facility. |
|---|
| 39 | 39 | | SECTION 2. A permit, registration, or other authorization |
|---|
| 40 | 40 | | issued by the Texas Commission on Environmental Quality that allows |
|---|
| 41 | 41 | | the land application of grease trap waste or grit trap waste expires |
|---|
| 42 | 42 | | on the effective date of this Act. The remainder of a permit, |
|---|
| 43 | 43 | | registration, or other authorization that contains items in |
|---|
| 44 | 44 | | addition to an authorization allowing the land application of |
|---|
| 45 | 45 | | grease trap waste or grit trap waste remains in effect to the extent |
|---|
| 46 | 46 | | that it does not authorize the land application of grease trap waste |
|---|
| 47 | 47 | | or grit trap waste. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2017. |
