8	8	AN ACT
9	9	relating to disclosure requirements of certain nursing facilities
10	10	that provide care for persons with Alzheimer's disease and related
11	11	disorders.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter B, Chapter 242, Health and Safety
14	14	Code, is amended by adding Section 242.0405 to read as follows:
15	15	Sec. 242.0405. NOTICE OF ALZHEIMER'S DISEASE AND RELATED
16	16	DISORDERS CERTIFICATION. (a) A nursing facility shall prepare a
17	17	written notice disclosing whether the facility is certified or is
18	18	not certified under Section 242.040 for the provision of
19	19	specialized care and treatment of residents with Alzheimer's
20	20	disease and related disorders.
21	21	(b) The nursing facility shall provide the notice described
22	22	by Subsection (a) to:
23	23	(1) each resident of the facility;
24	24	(2) each person applying for services from the
25	25	facility or the person's next of kin or guardian; and
26	26	(3) any person requesting the information.
27	27	(c) A nursing facility shall keep a record of each person to
28	28	whom notice is provided under Subsection (b).
29	29	SECTION 2. Section 242.042, Health and Safety Code, is
30	30	amended by adding Subsection (a-1) to read as follows:
31	31	(a-1) In addition to the information displayed under
32	32	Subsection (a), each institution shall prominently and
33	33	conspicuously post for display in a public area of the institution
34	34	that is readily available to residents, employees, and visitors a
35	35	written notice described by Section 242.0405.
36	36	SECTION 3. Section 242.202(d), Health and Safety Code, is
37	37	amended to read as follows:
38	38	(d) The disclosure statement must contain the following
39	39	categories of information:
40	40	(1) the institution's philosophy of care;
41	41	(2) [whether the institution is certified under
42	42	Section 242.040 for the provision of specialized care and treatment
43	43	of residents with Alzheimer's disease and related disorders;
44	44	[(3)] the preadmission, admission, and discharge
45	45	process;
46	46	(3) [(4)] resident assessment, care planning, and
47	47	implementation of the care plan;
48	48	(4) [(5)] staffing patterns, such as
49	49	resident-to-staff ratios, and staff training;
50	50	(5) [(6)] the physical environment of the
51	51	institution;
52	52	(6) [(7)] resident activities;
53	53	(7) [(8)] program costs;
54	54	(8) [(9)] systems for evaluation of the institution's
55	55	programs for residents;
56	56	(9) [(10)] family involvement in resident care; and
57	57	(10) [(11)] the toll-free telephone number maintained
58	58	by the department for acceptance of complaints against the
59	59	institution.
60	60	SECTION 4. As soon as practicable after the effective date
61	61	of this Act, the executive commissioner of the Health and Human
62	62	Services Commission shall adopt rules to implement the changes in
63	63	law made by this Act.
64	64	SECTION 5. This Act takes effect September 1, 2017.
