| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 201.604, Transportation Code, is amended | |
| 13 | 13 | by adding Subsection (f) to read as follows: | |
| 14 | 14 | (f) If the department violates a requirement relating to | |
| 15 | 15 | public participation in the environmental review of a | |
| 16 | 16 | transportation project under this section or under rules adopted to | |
| 17 | 17 | implement this section, the department is subject to a reduction of | |
| 18 | 18 | amounts appropriated for administration by the General | |
| 19 | 19 | Appropriations Act for the biennium following the biennium in which | |
| 20 | 20 | the violation occurs in an amount not to exceed $100,000 for each | |
| 21 | 21 | violation. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2017. |
