66 AN ACT
77 relating to regulation of short-term rentals by municipalities and
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 250, Local Government Code, is amended
1111 by adding Section 250.008 to read as follows:
1212 Sec. 250.008. REGULATION OF SHORT-TERM RENTALS. (a) In
1313 this section:
1414 (1) "Local law" means an ordinance, order, regulation,
1515 or similar measure.
1616 (2) "Short-term rental" means a residential property,
1717 including a single-family dwelling or a unit in a condominium,
1818 cooperative, or time-share, that is rented wholly or partly for a
1919 fee for a period not longer than 30 consecutive days.
2020 (b) A municipality or county may not adopt or enforce a
2121 local law that expressly or effectively prohibits the use of a
2222 property as a short-term rental. Except as provided by this
2323 section, a municipality or county may not adopt or enforce a local
2424 law that restricts the use of or otherwise regulates a short-term
2525 rental based on the short-term rental's classification, use, or
2626 occupancy.
2727 (c) A municipality or county may adopt or enforce a local
2828 law that specifically regulates property used as a short-term
2929 rental only if the county or municipality demonstrates that the
3030 local law's primary purpose is to protect the public's health and
3131 safety. Local laws authorized by this subsection include
3232 regulations:
3333 (1) addressing:
3434 (A) fire and building codes;
3535 (B) health and sanitation;
3636 (C) traffic control; and
3737 (D) solid or hazardous waste and pollution
3838 control; and
3939 (2) requiring the designation of an emergency contact
4040 for the property.
4141 (d) A municipality or county may adopt or enforce a local
4242 law that limits or prohibits the use of a short-term rental only if
4343 the law limits or prohibits the use of a rental for the purpose of:
4444 (1) housing sex offenders;
4545 (2) operating a structured sober living home or
4646 similar enterprise;
4747 (3) selling illegal drugs;
4848 (4) selling alcohol or another activity that requires
4949 a permit or license under the Alcoholic Beverage Code; or
5050 (5) operating as a sexually oriented business.
5151 (e) A municipality or county shall apply a local law
5252 regulating land use to a short-term rental in the same manner as
5353 another similar property. A local law described by this subsection
5454 includes regulations on:
5555 (1) residential use and other zoning matters;
5656 (2) noise;
5757 (3) property maintenance; and
5858 (4) nuisance.
5959 (f) This section may not be construed to affect regulations
6060 of a private entity, including a property owners' association as
6161 defined by Section 204.004, Property Code.
6262 SECTION 2. This Act takes effect September 1, 2017.
