15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 9 | | SECTION 1. Section 172.001, Transportation Code, is amended |
---|
17 | 10 | | by adding Subdivision (4-a) and amending Subdivision (7) to read as |
---|
18 | 11 | | follows: |
---|
19 | 12 | | (4-a) "Intelligent transportation system" means: |
---|
20 | 13 | | (A) innovative or intelligent technological |
---|
21 | 14 | | transportation systems, infrastructure, or facilities, including |
---|
22 | 15 | | elevated freight transportation facilities: |
---|
23 | 16 | | (i) in proximity to, or within, an existing |
---|
24 | 17 | | right-of-way on the state highway system; or |
---|
25 | 18 | | (ii) that connect land ports of entry to the |
---|
26 | 19 | | state highway system; |
---|
27 | 20 | | (B) communications or information processing |
---|
28 | 21 | | systems that improve the efficiency, security, or safety of freight |
---|
29 | 22 | | movement on the state highway system, including improving the |
---|
30 | 23 | | conveyance of freight on dedicated intelligent freight lanes; or |
---|
31 | 24 | | (C) a transportation facility or system that |
---|
32 | 25 | | increases truck freight efficiencies in the boundaries of an |
---|
33 | 26 | | intermodal facility or hub. |
---|
34 | 27 | | (7) "Rail facilities" means: |
---|
35 | 28 | | (A) passenger or freight rail facilities, |
---|
36 | 29 | | including: |
---|
37 | 30 | | (i) tracks; |
---|
38 | 31 | | (ii) a rail line; |
---|
39 | 32 | | (iii) switching, signaling, or other |
---|
40 | 33 | | operating equipment; |
---|
41 | 34 | | (iv) a depot; |
---|
42 | 35 | | (v) a locomotive; |
---|
43 | 36 | | (vi) rolling stock; |
---|
44 | 37 | | (vii) a maintenance facility; and |
---|
45 | 38 | | (viii) other real and personal property |
---|
46 | 39 | | associated with a rail operation; |
---|
47 | 40 | | (B) an intermodal hub; |
---|
48 | 41 | | (C) an automated conveyor belt for the movement |
---|
49 | 42 | | of freight; |
---|
50 | 43 | | (D) an intelligent transportation system that |
---|
51 | 44 | | operates with or as part of facilities described by Paragraphs |
---|
52 | 45 | | (A)-(C); or |
---|
53 | 46 | | (E) a system of facilities described by |
---|
54 | 47 | | Paragraphs (A)-(D) [property, or an interest in that property, that |
---|
55 | 48 | | the board determines is necessary or convenient to provide a rural |
---|
56 | 49 | | rail transportation system; and |
---|
57 | 50 | | [(B) property or an interest necessary or |
---|
58 | 51 | | convenient to acquire, provide, construct, enlarge, remodel, |
---|
59 | 52 | | renovate, improve, furnish, use, or equip the system, including: |
---|
60 | 53 | | [(i) a right-of-way; |
---|
61 | 54 | | [(ii) an earthwork or structure, including |
---|
62 | 55 | | clearing and grubbing of right-of-way, demolition of a structure, |
---|
63 | 56 | | relocation of utilities, a pipeline, or any other obstacle in a |
---|
64 | 57 | | right-of-way, stripping and stockpiling, removal of subsoil for |
---|
65 | 58 | | embankment or spoil, a borrow pit, dressing and seeding of a slope, |
---|
66 | 59 | | construction of a culvert, a road crossing, a bridge, restoration |
---|
67 | 60 | | of a roadway, drainage within a right-of-way or along a road |
---|
68 | 61 | | network, and restoration of a hydrologic system; |
---|
69 | 62 | | [(iii) trackwork; |
---|
70 | 63 | | [(iv) a train control, including |
---|
71 | 64 | | signalling, interlocking equipment, speed monitoring equipment, an |
---|
72 | 65 | | emergency braking system, a central traffic control facility, and a |
---|
73 | 66 | | communication system; |
---|
74 | 67 | | [(v) a passenger or freight service |
---|
75 | 68 | | building, terminal, or station, a ticketing facility, a waiting |
---|
76 | 69 | | area, a platform, a concession, an elevator, an escalator, a |
---|
77 | 70 | | facility for handicapped access, an access road, a parking facility |
---|
78 | 71 | | for passengers, a baggage handling facility, a local maintenance |
---|
79 | 72 | | facility, and offices for district purposes and includes an |
---|
80 | 73 | | interest in real property necessary or convenient for an item |
---|
81 | 74 | | listed under this subparagraph; |
---|
82 | 75 | | [(vi) rolling stock; and |
---|
83 | 76 | | [(vii) a maintenance facility]. |
---|
84 | 77 | | SECTION 2. Subchapter E, Chapter 172, Transportation Code, |
---|
85 | 78 | | is amended by adding Section 172.211 to read as follows: |
---|
86 | 79 | | Sec. 172.211. OTHER POWERS OF COUNTY, DISTRICT, AND |
---|
87 | 80 | | NAVIGATION DISTRICT. (a) This section applies only to a county |
---|
88 | 81 | | that: |
---|
89 | 82 | | (1) is adjacent to a county with a population of four |
---|
90 | 83 | | million or more; |
---|
91 | 84 | | (2) has a population of 300,000 or more; and |
---|
92 | 85 | | (3) has created a district by concurrent order with an |
---|
93 | 86 | | adjacent county pursuant to Section 172.052. |
---|
94 | 87 | | (b) A county acting through the commissioners court or a |
---|
95 | 88 | | local government corporation may adopt an order that authorizes the |
---|
96 | 89 | | county and a navigation district located wholly or partly in the |
---|
97 | 90 | | county to: |
---|
98 | 91 | | (1) develop rail facilities as a qualifying project |
---|
99 | 92 | | under Chapter 2267, Government Code; and |
---|
100 | 93 | | (2) issue bonds for rail facilities secured by a |
---|
101 | 94 | | pledge of the revenues of the facilities, including contract |
---|
102 | 95 | | revenue, grant revenue, or other revenue collected in connection |
---|
103 | 96 | | with the facilities. |
---|
104 | 97 | | (c) If each county that created a district adopts an order |
---|
105 | 98 | | described by Subsection (b), the district may exercise the powers |
---|
106 | 99 | | described by that subsection. |
---|
107 | 100 | | SECTION 3. This Act takes effect immediately if it receives |
---|
108 | 101 | | a vote of two-thirds of all the members elected to each house, as |
---|
109 | 102 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
110 | 103 | | Act does not receive the vote necessary for immediate effect, this |
---|
111 | 104 | | Act takes effect September 1, 2017. |
