114 AN ACT
125 relating to the development of certain local government
136 transportation infrastructure projects; authorizing the issuance
147 of bonds.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 172.001, Transportation Code, is amended
1710 by adding Subdivision (4-a) and amending Subdivision (7) to read as
1811 follows:
1912 (4-a) "Intelligent transportation system" means:
2013 (A) innovative or intelligent technological
2114 transportation systems, infrastructure, or facilities, including
2215 elevated freight transportation facilities:
2316 (i) in proximity to, or within, an existing
2417 right-of-way on the state highway system; or
2518 (ii) that connect land ports of entry to the
2619 state highway system;
2720 (B) communications or information processing
2821 systems that improve the efficiency, security, or safety of freight
2922 movement on the state highway system, including improving the
3023 conveyance of freight on dedicated intelligent freight lanes; or
3124 (C) a transportation facility or system that
3225 increases truck freight efficiencies in the boundaries of an
3326 intermodal facility or hub.
3427 (7) "Rail facilities" means:
3528 (A) passenger or freight rail facilities,
3629 including:
3730 (i) tracks;
3831 (ii) a rail line;
3932 (iii) switching, signaling, or other
4033 operating equipment;
4134 (iv) a depot;
4235 (v) a locomotive;
4336 (vi) rolling stock;
4437 (vii) a maintenance facility; and
4538 (viii) other real and personal property
4639 associated with a rail operation;
4740 (B) an intermodal hub;
4841 (C) an automated conveyor belt for the movement
4942 of freight;
5043 (D) an intelligent transportation system that
5144 operates with or as part of facilities described by Paragraphs
5245 (A)-(C); or
5346 (E) a system of facilities described by
5447 Paragraphs (A)-(D) [property, or an interest in that property, that
5548 the board determines is necessary or convenient to provide a rural
5649 rail transportation system; and
5750 [(B) property or an interest necessary or
5851 convenient to acquire, provide, construct, enlarge, remodel,
5952 renovate, improve, furnish, use, or equip the system, including:
6053 [(i) a right-of-way;
6154 [(ii) an earthwork or structure, including
6255 clearing and grubbing of right-of-way, demolition of a structure,
6356 relocation of utilities, a pipeline, or any other obstacle in a
6457 right-of-way, stripping and stockpiling, removal of subsoil for
6558 embankment or spoil, a borrow pit, dressing and seeding of a slope,
6659 construction of a culvert, a road crossing, a bridge, restoration
6760 of a roadway, drainage within a right-of-way or along a road
6861 network, and restoration of a hydrologic system;
6962 [(iii) trackwork;
7063 [(iv) a train control, including
7164 signalling, interlocking equipment, speed monitoring equipment, an
7265 emergency braking system, a central traffic control facility, and a
7366 communication system;
7467 [(v) a passenger or freight service
7568 building, terminal, or station, a ticketing facility, a waiting
7669 area, a platform, a concession, an elevator, an escalator, a
7770 facility for handicapped access, an access road, a parking facility
7871 for passengers, a baggage handling facility, a local maintenance
7972 facility, and offices for district purposes and includes an
8073 interest in real property necessary or convenient for an item
8174 listed under this subparagraph;
8275 [(vi) rolling stock; and
8376 [(vii) a maintenance facility].
8477 SECTION 2. Subchapter E, Chapter 172, Transportation Code,
8578 is amended by adding Section 172.211 to read as follows:
8679 Sec. 172.211. OTHER POWERS OF COUNTY, DISTRICT, AND
8780 NAVIGATION DISTRICT. (a) This section applies only to a county
8881 that:
8982 (1) is adjacent to a county with a population of four
9083 million or more;
9184 (2) has a population of 300,000 or more; and
9285 (3) has created a district by concurrent order with an
9386 adjacent county pursuant to Section 172.052.
9487 (b) A county acting through the commissioners court or a
9588 local government corporation may adopt an order that authorizes the
9689 county and a navigation district located wholly or partly in the
9790 county to:
9891 (1) develop rail facilities as a qualifying project
9992 under Chapter 2267, Government Code; and
10093 (2) issue bonds for rail facilities secured by a
10194 pledge of the revenues of the facilities, including contract
10295 revenue, grant revenue, or other revenue collected in connection
10396 with the facilities.
10497 (c) If each county that created a district adopts an order
10598 described by Subsection (b), the district may exercise the powers
10699 described by that subsection.
107100 SECTION 3. This Act takes effect immediately if it receives
108101 a vote of two-thirds of all the members elected to each house, as
109102 provided by Section 39, Article III, Texas Constitution. If this
110103 Act does not receive the vote necessary for immediate effect, this
111104 Act takes effect September 1, 2017.
