44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a sales and use tax exemption for property used in the
77 production of motion picture, video or audio master recordings.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 151.3185, Tax Code, is amended by
1010 amending Subsections (a) and (e) and adding Subsection (h) to read
1111 as follows:
1212 (a) The sale, lease, or rental or storage, use, or other
1313 consumption of the following items are exempted from the taxes
1414 imposed by this chapter:
1515 (1) tangible personal property that will become an
1616 ingredient or component part of:
1717 (A) a motion picture, [or] video, or audio master
1818 recording, a copy of which is sold or offered for ultimate sale,
1919 licensed, distributed, broadcast, or otherwise exhibited for
2020 consideration; or
2121 (B) a broadcast by a producer of cable programs
2222 or by a radio or television station licensed by the Federal
2323 Communications Commission;
2424 (2) tangible personal property that is necessary or
2525 essential to and used or consumed in or during:
2626 (A) the production of a motion picture, [or]
2727 video, or audio master recording, a copy of which is sold or offered
2828 for ultimate sale, licensed, distributed, broadcast, or otherwise
2929 exhibited for consideration; or
3030 (B) the production of a broadcast by or for a
3131 cable program producer or by or for a radio or television station
3232 licensed by the Federal Communications Commission; and
3333 (3) except as provided by Subsection (c), services
3434 that are necessary and essential to and used directly in a
3535 production described by Subdivision (2)(A) or (B).
3636 (e) The sale of a motion picture, video, or audio master
3737 recording by the producer of the master is exempt from the taxes
3838 imposed by this chapter.
3939 (h) For purposes of this section, "master recording" means
4040 the principal media on which images, sound, or a combination of
4141 images and sound are first fixed, and from which copies are
4242 commercially made available for sale, license, distribution,
4343 broadcast, or exhibition of the master recording or copies for
4444 consideration.
4545 SECTION 2. The changes in law made by this Act apply to
4646 master recordings sold, leased, rented, stored, used, or otherwise
4747 consumed on or after the effective date of this Act. Master
4848 recordings sold, leased, rented, stored, used, or otherwise
4949 consumed before that date are governed by the law in effect on the
5050 date of the sale, lease, rental, storage, use, or other consumption
5151 and the former law is continued in effect for that purpose.

5353 3. This Act takes effect September 1, 2017.
