| 7 | 7 | | production of motion picture, video or audio master recordings. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 151.3185, Tax Code, is amended by |
|---|
| 10 | 10 | | amending Subsections (a) and (e) and adding Subsection (h) to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (a) The sale, lease, or rental or storage, use, or other |
|---|
| 13 | 13 | | consumption of the following items are exempted from the taxes |
|---|
| 14 | 14 | | imposed by this chapter: |
|---|
| 15 | 15 | | (1) tangible personal property that will become an |
|---|
| 16 | 16 | | ingredient or component part of: |
|---|
| 17 | 17 | | (A) a motion picture, [or] video, or audio master |
|---|
| 18 | 18 | | recording, a copy of which is sold or offered for ultimate sale, |
|---|
| 19 | 19 | | licensed, distributed, broadcast, or otherwise exhibited for |
|---|
| 20 | 20 | | consideration; or |
|---|
| 21 | 21 | | (B) a broadcast by a producer of cable programs |
|---|
| 22 | 22 | | or by a radio or television station licensed by the Federal |
|---|
| 23 | 23 | | Communications Commission; |
|---|
| 24 | 24 | | (2) tangible personal property that is necessary or |
|---|
| 25 | 25 | | essential to and used or consumed in or during: |
|---|
| 26 | 26 | | (A) the production of a motion picture, [or] |
|---|
| 27 | 27 | | video, or audio master recording, a copy of which is sold or offered |
|---|
| 28 | 28 | | for ultimate sale, licensed, distributed, broadcast, or otherwise |
|---|
| 29 | 29 | | exhibited for consideration; or |
|---|
| 30 | 30 | | (B) the production of a broadcast by or for a |
|---|
| 31 | 31 | | cable program producer or by or for a radio or television station |
|---|
| 32 | 32 | | licensed by the Federal Communications Commission; and |
|---|
| 33 | 33 | | (3) except as provided by Subsection (c), services |
|---|
| 34 | 34 | | that are necessary and essential to and used directly in a |
|---|
| 35 | 35 | | production described by Subdivision (2)(A) or (B). |
|---|
| 36 | 36 | | (e) The sale of a motion picture, video, or audio master |
|---|
| 37 | 37 | | recording by the producer of the master is exempt from the taxes |
|---|
| 38 | 38 | | imposed by this chapter. |
|---|
| 39 | 39 | | (h) For purposes of this section, "master recording" means |
|---|
| 40 | 40 | | the principal media on which images, sound, or a combination of |
|---|
| 41 | 41 | | images and sound are first fixed, and from which copies are |
|---|
| 42 | 42 | | commercially made available for sale, license, distribution, |
|---|
| 43 | 43 | | broadcast, or exhibition of the master recording or copies for |
|---|
| 44 | 44 | | consideration. |
|---|
| 45 | 45 | | SECTION 2. The changes in law made by this Act apply to |
|---|
| 46 | 46 | | master recordings sold, leased, rented, stored, used, or otherwise |
|---|
| 47 | 47 | | consumed on or after the effective date of this Act. Master |
|---|
| 48 | 48 | | recordings sold, leased, rented, stored, used, or otherwise |
|---|
| 49 | 49 | | consumed before that date are governed by the law in effect on the |
|---|
| 50 | 50 | | date of the sale, lease, rental, storage, use, or other consumption |
|---|
| 51 | 51 | | and the former law is continued in effect for that purpose. |

| 53 | 53 | | 3. This Act takes effect September 1, 2017. |
