11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
---|
13 | 13 | | is amended by adding Section 32.02131 to read as follows: |
---|
14 | 14 | | Sec. 32.02131. LEGISLATIVE OVERSIGHT COMMITTEE ON THE |
---|
15 | 15 | | ALLOCATION OF MEDICAID BEDS IN NURSING FACILITIES. (a) In this |
---|
16 | 16 | | section: |
---|
17 | 17 | | (1) "Committee" means the legislative oversight |
---|
18 | 18 | | committee on the allocation of Medicaid beds in nursing facilities. |
---|
19 | 19 | | (2) "Nursing facility" means a nursing facility |
---|
20 | 20 | | licensed under Chapter 242, Health and Safety Code, that is a |
---|
21 | 21 | | provider under Medicaid. |
---|
22 | 22 | | (b) The committee is composed of six members as follows: |
---|
23 | 23 | | (1) two members of the senate and, subject to |
---|
24 | 24 | | Subsection (d), one representative of an owner or operator of a |
---|
25 | 25 | | nursing facility appointed by the lieutenant governor; and |
---|
26 | 26 | | (2) two members of the house of representatives and, |
---|
27 | 27 | | subject to Subsection (d), one representative of an owner or |
---|
28 | 28 | | operator of a nursing facility appointed by the speaker of the house |
---|
29 | 29 | | of representatives. |
---|
30 | 30 | | (c) A committee member serves at the pleasure of the |
---|
31 | 31 | | appointing official. |
---|
32 | 32 | | (d) Each committee member who is a representative of an |
---|
33 | 33 | | owner or operator of a nursing facility must reside in this state |
---|
34 | 34 | | and be involved in the day-to-day operation of the nursing |
---|
35 | 35 | | facility. |
---|
36 | 36 | | (e) The lieutenant governor and the speaker of the house of |
---|
37 | 37 | | representatives shall appoint the presiding officer of the |
---|
38 | 38 | | committee on an alternating basis. The presiding officer shall |
---|
39 | 39 | | serve a two-year term that expires February 1 of each odd-numbered |
---|
40 | 40 | | year. |
---|
41 | 41 | | (f) A vacancy on the committee shall be filled in the same |
---|
42 | 42 | | manner as the original appointment. |
---|
43 | 43 | | (g) The committee shall: |
---|
44 | 44 | | (1) meet at the call of the presiding officer; |
---|
45 | 45 | | (2) research, take public testimony, and issue reports |
---|
46 | 46 | | requested by the lieutenant governor or the speaker of the house of |
---|
47 | 47 | | representatives relating to the allocation of Medicaid beds in |
---|
48 | 48 | | nursing facilities in this state; |
---|
49 | 49 | | (3) monitor the effectiveness of the existing rules |
---|
50 | 50 | | adopted by the executive commissioner relating to the procedures |
---|
51 | 51 | | for certifying and decertifying Medicaid beds in nursing facilities |
---|
52 | 52 | | established under Section 32.0213 and consider the need for |
---|
53 | 53 | | modifications to existing rules to better control the procedures |
---|
54 | 54 | | for certifying and decertifying Medicaid beds in nursing |
---|
55 | 55 | | facilities; |
---|
56 | 56 | | (4) receive, review, and comment on rules proposed by |
---|
57 | 57 | | the executive commissioner relating to the procedures for |
---|
58 | 58 | | certifying and decertifying Medicaid beds in nursing facilities |
---|
59 | 59 | | established under Section 32.0213; and |
---|
60 | 60 | | (5) review recommendations for legislation relating |
---|
61 | 61 | | to the procedures for certifying and decertifying Medicaid beds in |
---|
62 | 62 | | nursing facilities. |
---|
63 | 63 | | (h) The committee may: |
---|
64 | 64 | | (1) propose legislation relating to the procedures for |
---|
65 | 65 | | certifying and decertifying Medicaid beds in nursing facilities |
---|
66 | 66 | | established under Section 32.0213; |
---|
67 | 67 | | (2) request reports and other information from the |
---|
68 | 68 | | commission; and |
---|
69 | 69 | | (3) issue process, in accordance with Section 301.024, |
---|
70 | 70 | | Government Code, to compel attendance of witnesses and the |
---|
71 | 71 | | production of books, records, documents, and instruments required |
---|
72 | 72 | | by the committee. |
---|
73 | 73 | | (i) The committee shall use the existing staff resources of |
---|
74 | 74 | | the senate and the house of representatives to assist the committee |
---|
75 | 75 | | in performing its duties under this section. |
---|
76 | 76 | | (j) A member of the committee may not receive compensation |
---|
77 | 77 | | for serving on the committee but is entitled to reimbursement for |
---|
78 | 78 | | travel expenses incurred by the member while conducting the |
---|
79 | 79 | | business of the committee, as provided in the General |
---|
80 | 80 | | Appropriations Act. |
---|
81 | 81 | | (k) Not later than November 15 of each even-numbered year, |
---|
82 | 82 | | the committee shall submit a report on the committee's activities |
---|
83 | 83 | | and the results of the committee's work to the governor, the |
---|
84 | 84 | | lieutenant governor, and the speaker of the house of |
---|
85 | 85 | | representatives. |
---|
86 | 86 | | (l) The committee is abolished and this section expires |
---|
87 | 87 | | September 1, 2021. |
---|
88 | 88 | | SECTION 2. As soon as practicable after the effective date |
---|
89 | 89 | | of this Act, the lieutenant governor and the speaker of the house of |
---|
90 | 90 | | representatives shall appoint members to the legislative oversight |
---|
91 | 91 | | committee on the allocation of Medicaid beds in nursing facilities |
---|
92 | 92 | | as required by Section 32.02131, Human Resources Code, as added by |
---|
93 | 93 | | this Act. The speaker of the house of representatives shall appoint |
---|
94 | 94 | | the first presiding officer of the committee. |
---|
95 | 95 | | SECTION 3. This Act takes effect September 1, 2017. |
---|
