99 relating to the creation of the legislative oversight committee on
1010 the allocation of Medicaid beds in nursing facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02131 to read as follows:
1414 Sec. 32.02131. LEGISLATIVE OVERSIGHT COMMITTEE ON THE
1515 ALLOCATION OF MEDICAID BEDS IN NURSING FACILITIES. (a) In this
1616 section:
1717 (1) "Committee" means the legislative oversight
1818 committee on the allocation of Medicaid beds in nursing facilities.
1919 (2) "Nursing facility" means a nursing facility
2020 licensed under Chapter 242, Health and Safety Code, that is a
2121 provider under Medicaid.
2222 (b) The committee is composed of six members as follows:
2323 (1) two members of the senate and, subject to
2424 Subsection (d), one representative of an owner or operator of a
2525 nursing facility appointed by the lieutenant governor; and
2626 (2) two members of the house of representatives and,
2727 subject to Subsection (d), one representative of an owner or
2828 operator of a nursing facility appointed by the speaker of the house
2929 of representatives.
3030 (c) A committee member serves at the pleasure of the
3131 appointing official.
3232 (d) Each committee member who is a representative of an
3333 owner or operator of a nursing facility must reside in this state
3434 and be involved in the day-to-day operation of the nursing
3535 facility.
3636 (e) The lieutenant governor and the speaker of the house of
3737 representatives shall appoint the presiding officer of the
3838 committee on an alternating basis. The presiding officer shall
3939 serve a two-year term that expires February 1 of each odd-numbered
4040 year.
4141 (f) A vacancy on the committee shall be filled in the same
4242 manner as the original appointment.
4343 (g) The committee shall:
4444 (1) meet at the call of the presiding officer;
4545 (2) research, take public testimony, and issue reports
4646 requested by the lieutenant governor or the speaker of the house of
4747 representatives relating to the allocation of Medicaid beds in
4848 nursing facilities in this state;
4949 (3) monitor the effectiveness of the existing rules
5050 adopted by the executive commissioner relating to the procedures
5151 for certifying and decertifying Medicaid beds in nursing facilities
5252 established under Section 32.0213 and consider the need for
5353 modifications to existing rules to better control the procedures
5454 for certifying and decertifying Medicaid beds in nursing
5555 facilities;
5656 (4) receive, review, and comment on rules proposed by
5757 the executive commissioner relating to the procedures for
5858 certifying and decertifying Medicaid beds in nursing facilities
5959 established under Section 32.0213; and
6060 (5) review recommendations for legislation relating
6161 to the procedures for certifying and decertifying Medicaid beds in
6262 nursing facilities.
6363 (h) The committee may:
6464 (1) propose legislation relating to the procedures for
6565 certifying and decertifying Medicaid beds in nursing facilities
6666 established under Section 32.0213;
6767 (2) request reports and other information from the
6868 commission; and
6969 (3) issue process, in accordance with Section 301.024,
7070 Government Code, to compel attendance of witnesses and the
7171 production of books, records, documents, and instruments required
7272 by the committee.
7373 (i) The committee shall use the existing staff resources of
7474 the senate and the house of representatives to assist the committee
7575 in performing its duties under this section.
7676 (j) A member of the committee may not receive compensation
7777 for serving on the committee but is entitled to reimbursement for
7878 travel expenses incurred by the member while conducting the
7979 business of the committee, as provided in the General
8080 Appropriations Act.
8181 (k) Not later than November 15 of each even-numbered year,
8282 the committee shall submit a report on the committee's activities
8383 and the results of the committee's work to the governor, the
8484 lieutenant governor, and the speaker of the house of
8585 representatives.
8686 (l) The committee is abolished and this section expires
8787 September 1, 2021.
8888 SECTION 2. As soon as practicable after the effective date
8989 of this Act, the lieutenant governor and the speaker of the house of
9090 representatives shall appoint members to the legislative oversight
9191 committee on the allocation of Medicaid beds in nursing facilities
9292 as required by Section 32.02131, Human Resources Code, as added by
9393 this Act. The speaker of the house of representatives shall appoint
9494 the first presiding officer of the committee.
9595 SECTION 3. This Act takes effect September 1, 2017.
