55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the civil jurisdiction of a justice court.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 26.042(a), Government Code, is amended
1010 to read as follows:
1111 (a) A county court has concurrent jurisdiction with the
1212 justice courts in civil cases in which the matter in controversy
1313 exceeds $200 in value but does not exceed $15,000 [$10,000],
1414 exclusive of interest.
1515 SECTION 2. Section 27.031(a), Government Code, is amended
1616 to read as follows:
1717 (a) In addition to the jurisdiction and powers provided by
1818 the constitution and other law, the justice court has original
1919 jurisdiction of:
2020 (1) civil matters in which exclusive jurisdiction is
2121 not in the district or county court and in which the amount in
2222 controversy is not more than $15,000 [$10,000], exclusive of
2323 interest;
2424 (2) cases of forcible entry and detainer;
2525 (3) foreclosure of mortgages and enforcement of liens
2626 on personal property in cases in which the amount in controversy is
2727 otherwise within the justice court's jurisdiction; and
2828 (4) cases arising under Chapter 707, Transportation
2929 Code, outside a municipality's territorial limits.
3030 SECTION 3. The change in law made by this Act applies only
3131 to a cause of action filed on or after the effective date of this
3232 Act. A cause of action filed before the effective date of this Act
3333 is governed by the law in effect immediately before the effective
3434 date of this Act, and that law is continued in effect for that
3535 purpose.
3636 SECTION 4. This Act takes effect September 1, 2017.
