99 relating to regulation by the Texas Department of Transportation of
1010 the spacing along highways of outdoor advertising in certain
1111 municipalities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 391, Transportation Code,
1414 is amended by adding Section 391.038 to read as follows:
1515 Sec. 391.038. SPACING REQUIREMENTS IN CERTAIN
1616 MUNICIPALITIES. (a) In this section, "electronic sign" means a
1717 sign that changes its message or copy by programmable electronic or
1818 mechanical processes.
1919 (b) The department, in regulating outdoor advertising
2020 located in the corporate boundaries of a municipality with a
2121 population of more than 200,000 located in a county on the
2222 Texas-Mexico border with a population of less than 300,000, may not
2323 require an electronic sign owned by the municipality to be more than
2424 500 feet from another sign.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2017.
