66 AN ACT
77 relating to demonstration projects to coordinate eligibility
88 renewal and eligibility recertification for certain children in the
99 Medicaid and child health plan programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 62, Health and Safety
1212 Code, is amended by adding Section 62.1025 to read as follows:
1313 Sec. 62.1025. ELIGIBILITY RENEWAL DEMONSTRATION PROJECT.
1414 (a) The commission shall establish a demonstration project through
1515 the child health plan program to allow the commission to
1616 simultaneously renew the eligibility of multiple children within
1717 the same household who are eligible for enrollment in the program.
1818 (b) The executive commissioner shall adopt rules necessary
1919 to determine the scope of, and eligibility for participating in,
2020 the demonstration project.
2121 (c) The commission shall operate the demonstration project
2222 under this section in conjunction with the demonstration project
2323 under Section 32.02614, Human Resources Code, if feasible.
2424 (d) Not later than December 1, 2020, the commission shall
2525 submit a report to the legislature regarding the commission's
2626 progress in establishing and operating the demonstration project
2727 and recommendations on continuing or expanding the demonstration
2828 project.
2929 (e) This section expires September 1, 2021.
3030 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
3131 is amended by adding Section 32.02614 to read as follows:
3232 Sec. 32.02614. ELIGIBILITY RECERTIFICATION DEMONSTRATION
3333 PROJECT. (a) The commission shall establish a demonstration
3434 project through the medical assistance program to allow the
3535 commission to simultaneously recertify the eligibility of multiple
3636 children within the same household who are eligible for medical
3737 assistance under this chapter.
3838 (b) The executive commissioner shall adopt rules necessary
3939 to determine the scope of, and eligibility for participating in,
4040 the demonstration project.
4141 (c) The commission shall operate the demonstration project
4242 under this section in conjunction with the demonstration project
4343 under Section 62.1025, Health and Safety Code, if feasible.
4444 (d) Not later than December 1, 2020, the commission shall
4545 submit a report to the legislature regarding the commission's
4646 progress in establishing and operating the demonstration project
4747 and recommendations on continuing or expanding the demonstration
4848 project.
4949 (e) This section expires September 1, 2021.
5050 SECTION 3. Not later than September 1, 2018, the Health and
5151 Human Services Commission shall implement the eligibility renewal
5252 and eligibility recertification demonstration projects required by
5353 Section 62.1025, Health and Safety Code, as added by this Act, and
5454 Section 32.02614, Human Resources Code, as added by this Act.
5555 SECTION 4. If before implementing any provision of this Act
5656 a state agency determines that a waiver or authorization from a
5757 federal agency is necessary for implementation of that provision,
5858 the agency affected by the provision shall request the waiver or
5959 authorization and may delay implementing that provision until the
6060 waiver or authorization is granted.
6161 SECTION 5. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2017.
