66 AN ACT
77 relating to broker agreements for the sale of real property by
88 school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.154, Education Code, is amended by
1111 adding Subsections (d) and (e) to read as follows:
1212 (d) If a contract is made under Subsection (c) with a
1313 licensed real estate broker to list the tract of real property for
1414 sale for at least 30 days with a multiple-listing service, the board
1515 of trustees on or after the 30th day after the date the property is
1616 listed may sell the tract of real property to a ready, willing, and
1717 able buyer who is produced by any broker using the multiple-listing
1818 service and who submits the highest cash offer.
1919 (e) The board of trustees may sell a tract of real property
2020 under this section without complying with the notice and bidding
2121 requirements prescribed by Section 272.001(a), Local Government
2222 Code, or other law.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
