| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 25.092, Education Code, is amended by | |
| 12 | 12 | adding Subsection (a-3) to read as follows: | |
| 13 | 13 | (a-3) In determining if a student has complied with | |
| 14 | 14 | attendance requirements under Subsection (a), the school district | |
| 15 | 15 | may not include any absence of a student from class if the student | |
| 16 | 16 | is absent to attend an extracurricular activity. In this | |
| 17 | 17 | subsection "extracurricular activity" means a voluntary activity | |
| 18 | 18 | sponsored by the school district and includes preparation for and | |
| 19 | 19 | involvement in public performances, contests, athletic | |
| 20 | 20 | competitions, demonstrations, displays, and club activities. | |
| 21 | 21 | SECTION 2. This Act applies beginning with the 2017-2018 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2017. |
