55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to including in the minimum attendance requirement of a
88 public school student any absence of the student to participate in
99 an extracurricular activity.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 25.092, Education Code, is amended by
1212 adding Subsection (a-3) to read as follows:
1313 (a-3) In determining if a student has complied with
1414 attendance requirements under Subsection (a), the school district
1515 may not include any absence of a student from class if the student
1616 is absent to attend an extracurricular activity. In this
1717 subsection "extracurricular activity" means a voluntary activity
1818 sponsored by the school district and includes preparation for and
1919 involvement in public performances, contests, athletic
2020 competitions, demonstrations, displays, and club activities.
2121 SECTION 2. This Act applies beginning with the 2017-2018
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
