| 10 | 10 | | metropolitan rapid transit authorities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 451.603(c), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (c) An election to withdraw may not be held [ordered, and a |
|---|
| 15 | 15 | | petition for an election to withdraw may not be accepted for filing, |
|---|
| 16 | 16 | | on or] before the first [fifth] anniversary of the first day of the |
|---|
| 17 | 17 | | calendar month in which a [after the date of a] previous election to |
|---|
| 18 | 18 | | withdraw [in] the unit of election [to withdraw] from the authority |
|---|
| 19 | 19 | | was held. |

| 20 | 20 | | SECTION 2. Section 451.607(c), Transportation Code, is |
|---|
| 21 | 21 | | amended to read as follows: |

| 22 | 22 | | (c) At the election the ballot shall be printed to provide |
|---|
| 23 | 23 | | for voting for or against the proposition: "Shall [the] (name of |
|---|
| 24 | 24 | | unit of election [authority]) withdraw from the [be continued in] |

| 26 | 26 | | SECTION 3. Section 451.608, Transportation Code, is amended |

| 27 | 27 | | to read as follows: |
|---|
| 28 | 28 | | Sec. 451.608. RESULT OF WITHDRAWAL ELECTION. (a) If a |
|---|
| 29 | 29 | | majority of the votes received on the measure in an election held |
|---|
| 30 | 30 | | under Section 451.607 favor the proposition, the [authority |
|---|
| 31 | 31 | | continues in the] unit of election withdraws from the authority and |
|---|
| 32 | 32 | | the authority ceases in the unit of election on the day after the |
|---|
| 33 | 33 | | date the election results are canvassed. |
|---|
| 34 | 34 | | (b) If less than a majority of the votes received on the |
|---|
| 35 | 35 | | measure in the election favor the proposition, the authority |
|---|
| 36 | 36 | | continues [ceases] in the unit of election [on the day after the day |
|---|
| 37 | 37 | | the election returns are canvassed]. |

| 38 | 38 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2017. |
