| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 42, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 42.1511 to read as follows: |
|---|
| 13 | 13 | | Sec. 42.1511. ALLOTMENT FOR STUDENTS RESIDING IN CARE AND |
|---|
| 14 | 14 | | TREATMENT FACILITIES. (a) For each student without a disability |
|---|
| 15 | 15 | | residing in a care and treatment facility, other than a state |
|---|
| 16 | 16 | | school, in a district in which the student's parent or legal |
|---|
| 17 | 17 | | guardian does not reside, a district is entitled to an annual |
|---|
| 18 | 18 | | allotment equal to the adjusted basic allotment multiplied by 4.0. |
|---|
| 19 | 19 | | For each student without a disability residing in a state school in |
|---|
| 20 | 20 | | a district in which the student's parent or legal guardian does not |
|---|
| 21 | 21 | | reside, a district is entitled to an annual allotment equal to the |
|---|
| 22 | 22 | | adjusted basic allotment multiplied by 2.8. |
|---|
| 23 | 23 | | (b) Funds allocated under this section must be used to |
|---|
| 24 | 24 | | assist districts in covering the expenses incurred by the district |
|---|
| 25 | 25 | | in providing education services to a student residing in a care and |
|---|
| 26 | 26 | | treatment facility or state school, including the costs associated |
|---|
| 27 | 27 | | with: |
|---|
| 28 | 28 | | (1) addressing the student's behavioral or |
|---|
| 29 | 29 | | psychological issues that require additional personnel or |
|---|
| 30 | 30 | | equipment; and |
|---|
| 31 | 31 | | (2) training personnel to provide education services |
|---|
| 32 | 32 | | to a student residing in a care and treatment facility or state |
|---|
| 33 | 33 | | school. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2017. |
