55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an allotment under the foundation school program for
88 students without disabilities residing in care and treatment
99 facilities or state schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 42, Education Code, is
1212 amended by adding Section 42.1511 to read as follows:
1313 Sec. 42.1511. ALLOTMENT FOR STUDENTS RESIDING IN CARE AND
1414 TREATMENT FACILITIES. (a) For each student without a disability
1515 residing in a care and treatment facility, other than a state
1616 school, in a district in which the student's parent or legal
1717 guardian does not reside, a district is entitled to an annual
1818 allotment equal to the adjusted basic allotment multiplied by 4.0.
1919 For each student without a disability residing in a state school in
2020 a district in which the student's parent or legal guardian does not
2121 reside, a district is entitled to an annual allotment equal to the
2222 adjusted basic allotment multiplied by 2.8.
2323 (b) Funds allocated under this section must be used to
2424 assist districts in covering the expenses incurred by the district
2525 in providing education services to a student residing in a care and
2626 treatment facility or state school, including the costs associated
2727 with:
2828 (1) addressing the student's behavioral or
2929 psychological issues that require additional personnel or
3030 equipment; and
3131 (2) training personnel to provide education services
3232 to a student residing in a care and treatment facility or state
3333 school.
3434 SECTION 2. This Act takes effect September 1, 2017.
