| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 775, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 775.0381 to read as follows: |
|---|
| 12 | 12 | | Sec. 775.0381. COMPENSATION IN CERTAIN POPULOUS COUNTIES. |
|---|
| 13 | 13 | | (a) This section applies only to an emergency services |
|---|
| 14 | 14 | | commissioner of a district located wholly in a county with a |
|---|
| 15 | 15 | | population of more than three million. |
|---|
| 16 | 16 | | (b) Notwithstanding Section 775.038(a), except as provided |
|---|
| 17 | 17 | | by Subsection (c), an emergency services commissioner is entitled |
|---|
| 18 | 18 | | to receive compensation of not more than $150 per day for each day |
|---|
| 19 | 19 | | the commissioner actually spends performing the duties of a |
|---|
| 20 | 20 | | commissioner. Compensation may not exceed $7,200 per year. |
|---|
| 21 | 21 | | Commissioners may be reimbursed for reasonable and necessary |
|---|
| 22 | 22 | | expenses incurred in performing official duties. |
|---|
| 23 | 23 | | (c) Notwithstanding Section 775.038(b), instead of |
|---|
| 24 | 24 | | compensation under Subsection (b), a commissioner may elect to |
|---|
| 25 | 25 | | receive per diem compensation of $150 for each day the commissioner |
|---|
| 26 | 26 | | actually spends performing the duties of a commissioner. A |
|---|
| 27 | 27 | | commissioner who receives per diem compensation may not be |
|---|
| 28 | 28 | | reimbursed for reasonable and necessary expenses. Per diem |
|---|
| 29 | 29 | | payments may not exceed $7,200 per year. |
|---|
| 30 | 30 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 31 | 31 | | the payment of compensation and per diem compensation of an |
|---|
| 32 | 32 | | emergency services commissioner for the performance of duties on or |
|---|
| 33 | 33 | | after the effective date of this Act. The payment of compensation or |
|---|
| 34 | 34 | | per diem compensation before the effective date of this Act is |
|---|
| 35 | 35 | | governed by the law in effect when the duty is performed, and the |
|---|
| 36 | 36 | | former law is continued in effect for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2017. |
