| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Chapter 13, Code of Criminal Procedure, is |
|---|
| 15 | 9 | | amended by adding Article 13.37 to read as follows: |
|---|
| 16 | 10 | | Art. 13.37. OBSTRUCTION OR RETALIATION. An offense under |
|---|
| 17 | 11 | | Section 36.06(a)(1), Penal Code, may be prosecuted in any county in |
|---|
| 18 | 12 | | which: |
|---|
| 19 | 13 | | (1) the harm occurs; or |
|---|
| 20 | 14 | | (2) the threat to do harm originated or was received. |
|---|
| 21 | 15 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 16 | | to venue for the trial of an offense committed on or after the |
|---|
| 23 | 17 | | effective date of this Act. Venue for the trial of an offense |
|---|
| 24 | 18 | | committed before the effective date of this Act is covered by the |
|---|
| 25 | 19 | | law in effect when the offense was committed, and the former law is |
|---|
| 26 | 20 | | continued in effect for that purpose. For purposes of this section, |
|---|
| 27 | 21 | | an offense was committed before the effective date of this Act if |
|---|
| 28 | 22 | | any element of the offense occurred before that date. |

| 29 | 23 | | SECTION 3. This Act takes effect September 1, 2017. |
