| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 411.1235(a), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (a) A volunteer fire department or a fire department | |
| 13 | 13 | operated by an emergency services district is entitled to obtain | |
| 14 | 14 | from the department criminal history record information maintained | |
| 15 | 15 | by the department that relates to a person who [is required to be | |
| 16 | 16 | certified by the Texas Commission on Fire Protection and]: | |
| 17 | 17 | (1) is an applicant for a beginning position with the | |
| 18 | 18 | fire department; or | |
| 19 | 19 | (2) currently holds a position with that fire | |
| 20 | 20 | department. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2017. |
