55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the use of portable testing equipment to
88 identify synthetic drugs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Abusable synthetic substance" has the meaning
1212 assigned by Section 484.001, Health and Safety Code.
1313 (2) "Synthetic controlled substance" means a
1414 substance listed in Penalty Group 2-A under Section 481.1031,
1515 Health and Safety Code.
1616 (3) "Synthetic drug" means an abusable synthetic
1717 substance or a synthetic controlled substance.
1818 (4) "Task force" means the Task Force on Synthetic
1919 Drug Testing created under this Act.
2020 SECTION 2. TASK FORCE; MEMBERSHIP. (a) The Task Force on
2121 Synthetic Drug Testing is created to investigate the use of
2222 portable testing devices for identification of synthetic drugs.
2323 (b) The task force consists of nine members, appointed as
2424 follows:
2525 (1) one member appointed by the commissioner of the
2626 Texas Commission on Law Enforcement;
2727 (2) one member appointed by the public safety director
2828 of the Department of Public Safety;
2929 (3) one member appointed by the attorney general;
3030 (4) two members appointed by the governor;
3131 (5) two members appointed by the lieutenant governor;
3232 and
3333 (6) two members appointed by the speaker of the house
3434 of representatives.
3535 (c) The members of the task force shall elect a presiding
3636 officer from among the membership.
3737 (d) Members of the task force serve without compensation and
3838 may not be reimbursed for travel or other expenses incurred while
3939 conducting the business of the task force.
4040 (e) The task force shall meet at the call of the presiding
4141 officer. The task force may meet telephonically in accordance with
4242 Section 551.125(b)(3), Government Code.
4343 SECTION 3. STUDY; REPORT. (a) The task force shall conduct a
4444 study on equipping law enforcement officers with portable testing
4545 devices capable of identifying an unidentified substance as a
4646 synthetic drug.
4747 (b) The study must address:
4848 (1) the accuracy of portable testing devices;
4949 (2) the cost of portable testing devices;
5050 (3) the admissibility in court of results of portable
5151 testing devices; and
5252 (4) any upgrades that would be needed to keep up with
5353 the pace at which synthetic drugs are chemically modified.
5454 (c) Not later than December 1, 2018, the task force shall
5555 submit to the legislature a report on the feasibility and
5656 desirability of equipping law enforcement officers with portable
5757 testing devices. The report submitted under this subsection must
5858 include any legislative recommendations by the task force.
5959 SECTION 4. EXPIRATION. This Act expires and the task force
6060 is abolished September 1, 2019.
6161 SECTION 5. EFFECTIVE DATE. This Act takes effect
6262 immediately if it receives a vote of two-thirds of all the members
6363 elected to each house, as provided by Section 39, Article III, Texas
6464 Constitution. If this Act does not receive the vote necessary for
6565 immediate effect, this Act takes effect September 1, 2017.
