55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of deadly force in defense of a person or
88 property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 9.41, Penal Code, is amended to read as
1111 follows:
1212 Sec. 9.41. PROTECTION OF ONE'S OWN PROPERTY. (a) A person
1313 in lawful possession of land, including a habitation on the land, or
1414 tangible, movable property is justified in using force against
1515 another when and to the degree the actor reasonably believes the
1616 force is immediately necessary to prevent or terminate the other's
1717 trespass on the land or unlawful interference with the property.
1818 (b) A person unlawfully dispossessed of land, including a
1919 habitation on the land, or tangible, movable property by another is
2020 justified in using force against the other when and to the degree
2121 the actor reasonably believes the force is immediately necessary to
2222 reenter the land or recover the property if the actor uses the force
2323 immediately or in fresh pursuit after the dispossession and:
2424 (1) the actor reasonably believes the other had no
2525 claim of right when he dispossessed the actor; or
2626 (2) the other accomplished the dispossession by using
2727 force, threat, or fraud against the actor.
2828 SECTION 2. Section 9.42, Penal Code, is amended to read as
2929 follows:
3030 Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
3131 justified in using deadly force against another to protect land,
3232 including a habitation on the land, or tangible, movable property
3333 if the actor:
3434 (1) is [if he would be] justified in using force
3535 against the other under Section 9.41; [and]
3636 (2) [when and to the degree he] reasonably believes
3737 the deadly force is immediately necessary:
3838 (A) to prevent the other's imminent commission of
3939 arson, burglary, robbery, aggravated robbery, theft during the
4040 nighttime, or criminal mischief during the nighttime; or
4141 (B) to prevent the other who is fleeing
4242 immediately after committing burglary, robbery, aggravated
4343 robbery, or theft during the nighttime from escaping with the
4444 property; and
4545 (3) [he] reasonably believes that:
4646 (A) the land or property cannot be protected or
4747 recovered by any other means; or
4848 (B) the use of force other than deadly force to
4949 protect or recover the land or property would expose the actor or
5050 another to a substantial risk of death or serious bodily injury.
5151 SECTION 3. Sections 9.32(a) and (c), Penal Code, are
5252 amended to read as follows:
5353 (a) A person is justified in using deadly force against
5454 another if the actor:
5555 (1) is [if the actor would be] justified in using force
5656 against the other under Section 9.31; [and]
5757 (2) is unable to safely retreat; and
5858 (3) [when and to the degree the actor] reasonably
5959 believes the deadly force is immediately necessary:
6060 (A) to protect the actor against the other's use
6161 or attempted use of unlawful deadly force; or
6262 (B) to prevent the other's imminent commission of
6363 aggravated kidnapping, murder, sexual assault, or aggravated
6464 sexual assault[, robbery, or aggravated robbery].
6565 (c) A person who is in the person's own habitation and [has a
6666 right to be present at the location where the deadly force is used,]
6767 who has not provoked the person against whom the deadly force is
6868 used[, and who is not engaged in criminal activity at the time the
6969 deadly force is used] is not required to retreat before using deadly
7070 force as described by this section.
7171 SECTION 4. Sections 9.32(b) and (d), Penal Code, are
7272 repealed.
7373 SECTION 5. The change in law made by this Act applies only
7474 to an offense committed on or after the effective date of this Act.
7575 An offense committed before the effective date of this Act is
7676 governed by the law in effect on the date the offense was committed,
7777 and the former law is continued in effect for that purpose. For
7878 purposes of this section, an offense was committed before the
7979 effective date of this Act if any element of the offense occurred
8080 before that date.
8181 SECTION 6. This Act takes effect September 1, 2017.
