55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the availability of dates of birth under the public
88 information law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 552, Government Code, is
1111 amended by adding Section 552.0222 to read as follows:
1212 Sec. 552.0222. DATE OF BIRTH. A date of birth is public
1313 information and not excepted from required disclosure unless made
1414 confidential under this chapter or other law.
1515 SECTION 2. Section 552.102, Government Code, is amended by
1616 adding Subsection (c) to read as follows:
1717 (c) This section does not exempt from disclosure a date of
1818 birth.
1919 SECTION 3. The changes in law made by this Act apply only to
2020 a request for information that is received by a governmental body or
2121 an officer for public information on or after the effective date of
2222 this Act. A request for information that was received before the
2323 effective date of this Act is governed by the law in effect on the
2424 date the request was received, and the former law is continued in
2525 effect for that purpose.
2626 SECTION 4. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2017.
