66 AN ACT
77 relating to overtime pay for child protective services employees in
88 the Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Section 40.03211 to read as follows:
1212 Sec. 40.03211. OVERTIME PAY FOR CHILD PROTECTIVE SERVICES
1313 PERSONNEL. The department may not authorize child protective
1414 services employees to work overtime hours unless the department has
1515 sufficient funds to fully compensate employees for the total number
1616 of hours worked during each pay period. The department may not delay
1717 compensation to child protective services employees for overtime
1818 hours worked during a pay period.
1919 SECTION 2. Immediately after the effective date of this
2020 Act, using funds appropriated to the Department of Family and
2121 Protective Services for the 2018-2019 fiscal biennium for the
2222 purpose of employee compensation, the department shall reimburse
2323 department employees who have previously worked overtime hours and
2424 are owed compensation for those hours by the department as of the
2525 effective date of this Act.
2626 SECTION 3. This Act takes effect September 1, 2017.
