| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 40, Human Resources Code, | |
| 11 | 11 | is amended by adding Section 40.03211 to read as follows: | |
| 12 | 12 | Sec. 40.03211. OVERTIME PAY FOR CHILD PROTECTIVE SERVICES | |
| 13 | 13 | PERSONNEL. The department may not authorize child protective | |
| 14 | 14 | services employees to work overtime hours unless the department has | |
| 15 | 15 | sufficient funds to fully compensate employees for the total number | |
| 16 | 16 | of hours worked during each pay period. The department may not delay | |
| 17 | 17 | compensation to child protective services employees for overtime | |
| 18 | 18 | hours worked during a pay period. | |
| 19 | 19 | SECTION 2. Immediately after the effective date of this | |
| 20 | 20 | Act, using funds appropriated to the Department of Family and | |
| 21 | 21 | Protective Services for the 2018-2019 fiscal biennium for the | |
| 22 | 22 | purpose of employee compensation, the department shall reimburse | |
| 23 | 23 | department employees who have previously worked overtime hours and | |
| 24 | 24 | are owed compensation for those hours by the department as of the | |
| 25 | 25 | effective date of this Act. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2017. |
