77 relating to examination requirements for child protective services

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Section 40.0328 to read as follows:
1212 Sec. 40.0328. CASEWORKER PROFESSIONAL DEVELOPMENT
1313 EXAMINATION. (a) A child protective services caseworker may not
1414 work in the field unless the caseworker has passed the child
1515 protective services professional development examination with a
1616 score of 70 percent or more.
1717 (b) A caseworker who does not pass the child protective
1818 services professional development examination may not retake the
1919 examination until the caseworker has completed a skills development
2020 plan under the supervision of the caseworker's direct supervisor.
2121 A caseworker may not take the examination more than three times.
2222 (c) The department may annually update the child protective
2323 services professional development examination.
2424 (d) The executive commissioner may adopt rules to implement
2525 this section.
2626 SECTION 2. This Act takes effect September 1, 2017.
