55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the evaluation of an application for a low income
88 housing tax credit.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.6704(b-1), Government Code, is
1111 amended to read as follows:
1212 (b-1) The preapplication process must require the applicant
1313 to provide the department with evidence that the applicant:
1414 (1) has notified the following entities with respect
1515 to the filing of the application:
1616 (A) [(1)] any neighborhood organizations on
1717 record with the state or county in which the development is to be
1818 located and whose boundaries contain the proposed development site;
1919 (B) [(2)] the superintendent and the presiding
2020 officer of the board of trustees of the school district containing
2121 the development;
2222 (C) [(3)] the presiding officer of the governing
2323 body of any municipality containing the development and all elected
2424 members of that body;
2525 (D) [(4)] the presiding officer of the governing
2626 body of the county containing the development and all elected
2727 members of that body; and
2828 (E) [(5)] the state senator and state
2929 representative of the district containing the development; and
3030 (2) has obtained written statements of support for the
3131 application from the state senator and state representative who
3232 represent the district containing the proposed development site.
3333 SECTION 2. The change in law made by this Act applies only
3434 to an application for low income housing tax credits that is
3535 submitted to the Texas Department of Housing and Community Affairs
3636 during an application cycle that is based on the 2018 qualified
3737 allocation plan or a subsequent plan adopted by the governing board
3838 of the department under Section 2306.67022, Government Code. An
3939 application that is submitted during an application cycle that is
4040 based on an earlier qualified allocation plan is governed by the law
4141 in effect on the date the application cycle began, and the former
4242 law is continued in effect for that purpose.
4343 SECTION 3. This Act takes effect September 1, 2017.
