| 7 | 7 | | relating to the evaluation of an application for a low income |
|---|
| 8 | 8 | | housing tax credit. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2306.6704(b-1), Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b-1) The preapplication process must require the applicant |
|---|
| 13 | 13 | | to provide the department with evidence that the applicant: |
|---|
| 14 | 14 | | (1) has notified the following entities with respect |
|---|
| 15 | 15 | | to the filing of the application: |
|---|
| 16 | 16 | | (A) [(1)] any neighborhood organizations on |
|---|
| 17 | 17 | | record with the state or county in which the development is to be |
|---|
| 18 | 18 | | located and whose boundaries contain the proposed development site; |
|---|
| 19 | 19 | | (B) [(2)] the superintendent and the presiding |
|---|
| 20 | 20 | | officer of the board of trustees of the school district containing |
|---|
| 21 | 21 | | the development; |
|---|
| 22 | 22 | | (C) [(3)] the presiding officer of the governing |
|---|
| 23 | 23 | | body of any municipality containing the development and all elected |
|---|
| 24 | 24 | | members of that body; |
|---|
| 25 | 25 | | (D) [(4)] the presiding officer of the governing |
|---|
| 26 | 26 | | body of the county containing the development and all elected |
|---|
| 27 | 27 | | members of that body; and |
|---|
| 28 | 28 | | (E) [(5)] the state senator and state |
|---|
| 29 | 29 | | representative of the district containing the development; and |
|---|
| 30 | 30 | | (2) has obtained written statements of support for the |
|---|
| 31 | 31 | | application from the state senator and state representative who |
|---|
| 32 | 32 | | represent the district containing the proposed development site. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to an application for low income housing tax credits that is |
|---|
| 35 | 35 | | submitted to the Texas Department of Housing and Community Affairs |
|---|
| 36 | 36 | | during an application cycle that is based on the 2018 qualified |
|---|
| 37 | 37 | | allocation plan or a subsequent plan adopted by the governing board |
|---|
| 38 | 38 | | of the department under Section 2306.67022, Government Code. An |
|---|
| 39 | 39 | | application that is submitted during an application cycle that is |
|---|
| 40 | 40 | | based on an earlier qualified allocation plan is governed by the law |
|---|
| 41 | 41 | | in effect on the date the application cycle began, and the former |
|---|
| 42 | 42 | | law is continued in effect for that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2017. |
