99 relating to the participation of speech-language pathologists as
1010 providers under the Medicaid program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.027, Human Resources Code, is amended
1313 by adding Subsection (n) to read as follows:
1414 (n) The commission shall assure that a recipient of medical
1515 assistance under this chapter may select a licensed speech-language
1616 pathologist, as defined by Section 401.001, Occupations Code, to
1717 perform any health care service covered under the medical
1818 assistance program if the pathologist is authorized by law to
1919 perform the service.
2020 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
2121 is amended by adding Section 32.081 to read as follows:
2222 Sec. 32.081. PRIVATE PRACTICE SPEECH-LANGUAGE PATHOLOGISTS
2323 AS MEDICAL ASSISTANCE PROVIDERS. (a) The commission shall ensure
2424 that licensed speech-language pathologists, as defined by Section
2525 401.001, Occupations Code, in private practice may:
2626 (1) enroll under the medical assistance program as
2727 independent practice providers or as a group practice provider
2828 composed of multiple speech-language pathologists, provided that
2929 each speech-language pathologist in the group practice is
3030 individually enrolled as a medical assistance provider; and
3131 (2) once enrolled as a medical assistance provider,
3232 serve all medical assistance recipients without being limited to
3333 participation in the Texas Health Steps Comprehensive Care Program.
3434 (b) This section does not authorize a provider to provide
3535 speech-language pathology services to recipients as home health
3636 services without an appropriate license under Section 142.002,
3737 Health and Safety Code.
3838 SECTION 3. If before implementing any provision of this Act
3939 a state agency determines that a waiver or authorization from a
4040 federal agency is necessary for implementation of that provision,
4141 the agency affected by the provision shall request the waiver or
4242 authorization and may delay implementing that provision until the
4343 waiver or authorization is granted.
4444 SECTION 4. This Act takes effect September 1, 2017.
