| 8 | 8 | | governmental record; increasing a criminal penalty. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 37.10(c), Penal Code, is amended by |
|---|
| 11 | 11 | | amending Subdivision (1) and adding Subdivision (5) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (1) Except as provided by Subdivisions (2), (3), [and] |
|---|
| 14 | 14 | | (4), and (5) and by Subsection (d), an offense under this section is |
|---|
| 15 | 15 | | a Class A misdemeanor unless the actor's intent is to defraud or |
|---|
| 16 | 16 | | harm another, in which event the offense is a state jail felony. |
|---|
| 17 | 17 | | (5) An offense under this section is a state jail |
|---|
| 18 | 18 | | felony if it is shown on the trial of the offense that the |
|---|
| 19 | 19 | | governmental record was a payroll document requesting payment of |
|---|
| 20 | 20 | | compensation to a state officer or employee. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 22 | | to an offense committed on or after the effective date of this Act. |
|---|
| 23 | 23 | | An offense committed before the effective date of this Act is |
|---|
| 24 | 24 | | governed by the law in effect on the date the offense was committed, |
|---|
| 25 | 25 | | and the former law is continued in effect for that purpose. For |
|---|
| 26 | 26 | | purposes of this section, an offense was committed before the |
|---|
| 27 | 27 | | effective date of this Act if any element of the offense occurred |
|---|
| 28 | 28 | | before that date. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2017. |
