| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2004.002(2), Occupations Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (2) "Professional sports team" means: |
|---|
| 13 | 13 | | (A) a team organized in this state that is a |
|---|
| 14 | 14 | | member of: |
|---|
| 15 | 15 | | (i) Major League Baseball; |
|---|
| 16 | 16 | | (ii) [,] the National Basketball |
|---|
| 17 | 17 | | Association; |
|---|
| 18 | 18 | | (iii) [,] the National Hockey League; |
|---|
| 19 | 19 | | (iv) [,] the National Football League; [,] |
|---|
| 20 | 20 | | or |
|---|
| 21 | 21 | | (v) Major League Soccer; or |
|---|
| 22 | 22 | | (B) a person hosting a motorsports racing team |
|---|
| 23 | 23 | | event sanctioned by the National Association for Stock Car Auto |
|---|
| 24 | 24 | | Racing (NASCAR), INDYCar, or another nationally recognized |
|---|
| 25 | 25 | | motorsports racing association at a venue in this state with a |
|---|
| 26 | 26 | | permanent seating capacity of not less than 75,000. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect on December 1, 2017, but |
|---|
| 28 | 28 | | only if the constitutional amendment proposed by the 85th |
|---|
| 29 | 29 | | Legislature, Regular Session, 2017, to authorize additional |
|---|
| 30 | 30 | | professional sports team charitable foundations to conduct |
|---|
| 31 | 31 | | charitable raffles at additional venues is approved by the voters. |
|---|
| 32 | 32 | | If that amendment is not approved by the voters, this Act has no |
|---|
| 33 | 33 | | effect. |
|---|
